Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Barown seconded the motion. The invoices and payments have been presented and accepted. All in favor 4 yes 0 no. Motion carried.

Presentation of Invoices and Payments:
• Budget reviewed as well as NBT Account balances.

Misc. information to the Town Clerk:
• Sales tax for the month of AUG 2016 $6,575.66
• Dog report submitted by the DCO for the months of Dec 2015-Aug 2016
• $5,000 check from WalMart for the resurfacing of the Gym Floor
• Comptroller’s Audit is complete and available for the public to view in the Town Clerk Office during regular business hours.

Community Center/Alden Fields and Park:
• The gym floor is completed and looks fantastic.
• Fall activities are scheduled to begin next month.

Health Center:
• Itemized Health Center Budget reviewed
• The Health Center will have its own Itemized Expenses included on the monthly abstracts presented to the Town Board.

Highway:
• New truck is in the shop.

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Councilperson Barown announced he will be running for Town Justice as a write-in. He checked with the State and he does not have to step down from his current roll as Councilperson, however the Town Board will have a vacancy after the Elections beginning in January. The vacant position will be advertised in January 2017.

Preliminary Budget is presented to the Town Board and is available for view at the Town Clerk’s office during regular business hours.

PUBLIC HEARING FOR LOCAL LAW 2016-1 2017 PROPERTY TAX CAP LEVY OVERRIDE is opened at 6:55PM with a motion from Councilperson Barown and 2nd by Councilperson Cornwell. 5-yes 0-no

Public present asked for an explanation for the tax cap levy override.

The Board explained this is required by the State of New York if the Town Budget exceeds a certain level the Town has to have a local law to override the cap in order to make budget. The State put this in place approximately 4 years ago and every year the Town passes a local Law to override the cap if need be.

Motion to close the Public Hearing is made by Councilperson Barown and 2nd by Councilperson Johnson 5-yes 0-no

The Justice books have been audited by the Town Board.

Resolution 2016-7 Audit of the Town Justice Court Records has been presented to the Town Board. Motion made by Councilperson Cornwell to accept the Resolution as presented. 2nd by Councilperson Barown. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Waterfield-yes 5-yes 0-no

Local Law 2016-1 is duly passed.

Tentative Budget for 2017 is disbursed to the Town Board for their review. Corrections to the budget should be made to the Town Supervisor in a timely manner.
