Village:
• Town and Village Board Minutes and info- www.cherryvalleyny.us
• Supervisor Garretson asking if everyone is ok with transferring the Town Parking lot to the Village. The Village wants to put a solar field in the back part of the parking lot.
• Councilperson Cornwell had questions regarding the proposed solar field the Village plans on putting on the property. Councilperson Cornwell also asked if the Town has first refusal if the Village has any planning of future development of the land.
Town Planning:
• Motion to appointment Lorraine Bosma as chairperson of the Planning Board made by Jim Johnson 2nd by Councilperson VanDerwerker. All in favor 4-yes 0-no
• Draft Solar Law is still a work in progress. Holly is not here to report updates.
Highway Department:
• Superintendent of Highways Tony Miles went and looked at the used 2001 Grade-All and stated it looked to be in good shape. The bucket is junk, but they have another bucket they are going to put on it. This kind of purchase will need to go out for bid and an ad will be placed in the paper.
• Truck is being built
Superintendent Garretson received a call from Karen Sullivan from the county asking to have an electronics collection day at the Community Center.

Andy Minnig expressing thanks from Jane Sapinsky from Artworks for the Towns donation
Mr. Minnig inquired about the Solar Law progress.
Mr. Minnig also agreed with Councilperson Cornwell regarding the property/parking lot transaction with the Village.

Councilperson Waterfield gave an overview of a potential Solar Law. Main concern is who and how will the Town enforce the Law. Some of the bullet points are:
• Reporting and tracking large scale systems
• Owner or operator would have the facility inspected annually and file this report with the Town
• Need to know what needs to be included in report and if everything is sufficient
• Keeping track of where the properties are, who the contact is and have a follow up procedure for what happens if the owner/operator doesn’t file with the Town.
• Planning Board wants to put most of the responsibility on the owner and how to deal with an owner who does not comply, etc.
• Would the Town have a code enforcement officer? The County will not participate in this type of enforcement.
• Supervisor Garretson suggested reaching out to the Town Attorney for wording of a Solar Law.
Supervisor Garretson emailed Dave Bliss regarding the recyclable issues at the Town site. Dave forwarded the email to Karen Sullivan and she forwarded the email to Cassella.
Motion for the Superintendent of Highways to purchase a new truck through the Piggyback program through Chenango County made by Councilperson VanDerwerker Councilperson Johnson 2nd the motion. Motion carried.
Town Justice position currently held by Chris Barown will be on the November Ballot.

Kathleen Taylor presents information regarding School Ballot initiative for the 4 county Library systems. The initiative would address increasing school taxes to meet annual Library budgets. A Library line would appear on the school taxes. The School has to put it on the Ballot in May for the public to vote yeah or nah to increase the taxes to support our local libraries in Cherry Valley and Springfield.

Annual Organizational Meeting of the Cherry Valley Town Board
January 2020
The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.
If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.
Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.
96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Town Supervisor will serve as the Town Budget Officer.
The Budget Officer is authorized to pay employees, insurance, utility, communication and any other due invoices prior to the review and approval of the town board.
The Budget Officer will provide all paid invoices with attached check stubs for monthly town board audit review and approval.
The Budget Officer will provide proof of any voided, damaged or destroyed check.

Included in the adopted 2020 Town Budget, are the following budgets:

The Town Clerk will stamp all Resolutions, Local Laws, and Payment Acceptance Agreements with the Official Town of Cherry Valley Stamp.
One copy of each stamped document will be provided to the Town Supervisor.

An op-out insurance program is available to full time employees - proof of other health insurance coverage is required – the annual op-out payment is based on the single package contract rate premium for the year. The op-out payment for 2020 is $17,808

CP Waterfield is looking into the County’s webite’s shared service to put the Town documents on their Web Site.

Scott Moxham from On Time Waste respectfully commented on the County recyclable bins overflowing while he is in attendance for garbage pick up. People are very upset and frustrated and he is taking a lot of heat for this problem that does not belong to On Time Waste. Hoping there is resolution to this issue with the County Recyclable bins in the near future.

The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.
If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.
Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.
96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

Planning Board:
• Planning Board submitted a Solar Regulations packet to the Town Board for their review and comments.
• Supervisor Garretson received a call from Adam Mitchell and is interested in purchasing the CV Hardware store and is looking for extra property via the Town parking lot for miscellaneous use. Supervisor Garretson spoke with the Town Attorney, Will Green, and discussed leasing the parking lot to Adam and to the Village instead of selling the land solely to the Village.
Highway Department:
• Superintendent of Highways Miles met with an underwriter for the insurance companies for an audit and there were two items that needed to be addressed, signs for the building and a container for flammable liquids. Emergency shut off valve for the diesel tank. Also driver assessments for all Town Highway employees.

• Planning Board submitted a Solar Regulations packet to the Town Board for their review and comments.
• Supervisor Garretson received a call from Adam Mitchell and is interested in purchasing the CV Hardware store and is looking for extra property via the Town parking lot for miscellaneous use. Supervisor Garretson spoke with the Town Attorney, Will Green, and discussed leasing the parking lot to Adam and to the Village instead of selling the land solely to the Village.
Highway Department:
• Superintendent of Highways Miles met with an underwriter for the insurance companies for an audit and there were two items that needed to be addressed, signs for the building and a container for flammable liquids. Emergency shut off valve for the diesel tank. Also driver assessments for all Town Highway employees.

• Mayor Guido spoke with Supervisor Garretson and inquired if the Town would be interested in selling the Public Parking Lot to the Village. The Town Board will consider this inquisition and there will be further discussions on the matter.
Planning Board:
• Motion made by Councilperson VanDerWerker to appoint Ellen LaSalle to the vacant seat on the Planning Board seconded by Councilperson Waterfield. All in favor 5-yes 0-no
• Planning Board Chair, Julie Barown communicated to the Town Board that the Town Planning Board would like to be included in the Solar Law when drafted.
Highway Department:
• Highway Superintendent Miles will contact Jerry Burillo regarding snow and ice
• Waiting to hear if the truck has been sold. A gentleman from Maine is interested.
• Motion to accept the bid for the truck made by Councilperson Cornwell seconded by Councilperson Johnson. All in favor 5-yes 0-no Motion carried.
• HS Miles presented the extra warranty for the new truck which includes towing and wiring harness is $5,294. It was not included in the Bid. The warranty is for 12 months or 100,000 miles whichever comes first. Town Board ok to purchase.

Planning Board:
• Motion made by Councilperson VanDerWerker to appoint Ellen LaSalle to the vacant seat on the Planning Board seconded by Councilperson Waterfield. All in favor 5-yes 0-no
• Planning Board Chair, Julie Barown communicated to the Town Board that the Town Planning Board would like to be included in the Solar Law when drafted.
Highway Department:
• Highway Superintendent Miles will contact Jerry Burillo regarding snow and ice
• Waiting to hear if the truck has been sold. A gentleman from Maine is interested.
• Motion to accept the bid for the truck made by Councilperson Cornwell seconded by Councilperson Johnson. All in favor 5-yes 0-no Motion carried.

Resolution 2019-3 NYS now and Ice Contract Amendment
Proposed Action: Amendment to Contract #D01680 of the Municipal Snow and Ice Contract Agreement
Whereas, due to the severity of the winter and the high cost of fuel during the 2018/2019 season, the municipality request that the Municipal Snow and ice Agreement estimated expenditure be revised to reflect the additional lane miles of state roads that were plowed and or treated during the aforementioned season, and the additional costs associated with the higher fuel prices, and
Whereas, all terms and conditions of the original contract extension remain in effect except the original estimated expenditure of $64,059.12 will have an additional adjustment of $45,481.98 for a revised estimated expenditure of $109,541.10, and
Now, therefore be it resolved, this board authorizes Thomas Garretson-Supervisor to enter into amendment B which will adjust the snow and ice contract for a revised payment factor with the New York State Department of Transportation.

Now, therefore be it resolved, this board authorizes Thomas Garretson-Supervisor to enter into amendment B which will adjust the snow and ice contract for a revised payment factor with the New York State Department of Transportation.
