• Julie Barown, Chairperson, informed the board of 2 candidates interested in being appointed to the Town Planning Board. They are Lisa Hershey and Karen Walker. Motion to appoint Lisa Hershey and Karen Walker to the Town Planning Board is made by Councilperson Cornwell 2nd Councilperson Johnson 4 yes 0 no motion carried.

Village:

• Dave Bliss County Rep is present at tonight’s meeting and gave an update on County issues.

Resolution 2019-2 Audit of Town Justice Court Records and Dockets

Motion to accept Resolution 2019-2 made by Councilperson Johnson and 2nd Councilperson VanDerWerker Roll call Vote: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerWerker-yes and Councilperson Cornwell-yes. 4 yes 0 no.


Public Questions, Comments and Concerns:
Karen Sullivan, Planning and solid waste Director for Otsego County and Karey Foster from Casella’s Waste presented packets of information regarding recycling costs for the County and how this affects each Town in Otsego County. Karen’s goal is decreasing contaminated recyclables and re-educate people to clean all of their recyclables. Also asking the Town to come up with a plan to make certain the recyclable site is monitored during the day and during the open areas. Discussed locking the bins during off hours.

Karen also presented Hazardous Mitigation info.

Community Center Alden Field and Park:
• Biddy basketball season in full swing
• Open basketball Wednesday nights from 7-9 through April 2019
• Proposed pre-school play group for Tuesdays from 9-10:30 Feb-Apr will fall under the Town Youth program. Jen Bishop has agreed to be the contact person for information regarding the play group.

Miscellaneous:
• Town Clerk checking account statements check book and record books were audited by the Town Board.

Town Planning Board:
• Three individuals have contacted Supervisor Garretson regarding the vacancies on the Planning Board. Lisa, Hershey, Dave Lamouret and Kathy Walker.

Village:
• Councilperson Waterfield inquired about what happened with the Village dumping debris from the burned out house on Lancaster St in the Town dump. The Village was fined and had to remove what was dumped in the dump.

Highway Department:
• New plow truck has been ordered and should be ready for the 2019 snow season.
• Motion made by Councilperson VanDerWerker to allow the Town Highway Superintendent start the process again to replace another plow truck motion 2nd by Councilperson Johnson. All in favor 4-yes and 0-no. Motion carried.
• Supervisor Garretson received notification the Town holds the registration for solid waste facility. This must be referring to the Dump.
• Meeting on Jan 29 5-8PM-Hazard mitigation meeting with the County for discussion for emergency stream and culvert intervention. DEC has targeted the Cherry Valley creek watershed will be part of a study in 2019.

The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.

If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.

Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.

96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Superintendent of Highways is authorized to purchase equipment and replacement parts prior to the review and approval of the town board, not to exceed $3,500

The Town Supervisor will provide the Community Center Director with an annual budget and provide monthly updates of revenue and expense.

The Cherry Valley Community Center Director will be responsible for organizing and conducting an annual meeting with all parties involved with the use and maintenance of the Community Center and Alden Fields.
The Town Supervisor will serve as Chairman of the Cherry Valley Health Center Board.

The Town Supervisor will provide the Cherry Valley Health Center Board with an annual budget and provide monthly updates of revenue and expense.

Town paid medical, dental and vision insurance coverage is available to full time employees – town paid medical, dental and vision insurance is not available to employees that chose the op-out program. (details below)

An op-out insurance program is available to full time employees - proof of other health insurance coverage is required – the annual op-out payment is based on the single package contract rate premium for the year. The op-out payment for 2019 is $10,320

Cintas work clothes provided daily to the highway department employees

Disability payment to full time employees is $510 / wk

Death benefit - payable to the estate of the full time employee is $100,000

• There is some mold issues in the basement that are being addressed.

• Letter received and presented to the Town Board from Darlene Fox regarding the installation of the proposed solar panels on the Cherry Valley Springfield School property.


Town Planning Board:
• Two vacancies currently open. Vacancies have been advertised and posted in the Town Clerk info board at the Post Office. So far no inquiries.

Highway Department:
• Motion to accept the quotes from Burr-$120,542.00 and Henderson-$93,764.00 the new truck construction made by Councilman VanDerWerker and 2nd by Councilperson Johnson 4-yes 0-no
• Gravel permit received for Mike Stocking using Kuckenberger’s gravel pit (not in the Town of Cherry Valley). Not sure why CV Town Supervisor receives this. Could be because Mike’s address is Cherry Valley.

Public Questions, Comments and Concerns:

Dave Lamouret addressed the Town Board regarding an incentive last year for municipalities to combine services and there would be a grant back 2x of what was saved. Councilperson Waterfield stated the Board will have to check back with County rep Dave Bliss for an update on this matter. Dave Lamouret also expressed interest in being the Tax Collector when the time comes that a new tax collector needs to be appointed or when the current Tax Collector does not wish to continue on as the Town Tax Collector. He also inquired about the Planning Board vacancies.

Supervisor Garretson handed out an information sheet regarding what the Town Board can and cannot do in terms of a Zoning Law of Appeals or a Town Planning Board decision.

Supervisor Garretson presented the Preliminary Budget for 2019 to the Town Board. Councilperson Cornwell made a motion to adopt the Preliminary Budget for the year 2019 and a 2nd by Councilperson VanDerWerker. All in favor 5-yes 0-no. 2019 Preliminary Budget is adopted.

Resolution 2018-11 Snow and Ice Contract Extension 2018/2019-between NYSDOT and the Town of Cherry Valley

Proposed Action: Snow and Ice Contract Extension 2018/2019- between NYSDOT and the Town of Cherry Valley

Whereas, the NYSDOT and the Town of Cherry Valley have entered into agreement #D010680 entitled “Indexed Lump Sum Snow and Ice Agreement between the New York State Department of Transportation and the Town of Cherry Valley dated January 14th 1997, and

Whereas, the present term of the agreement as previously extended, expires June 30th 2017, and

Whereas, the said agreement provides for an annual update of the estimated expenditure to be determined by NYSDOT, and

Now, therefore be it resolved: The aforementioned agreement between the NYSDOT and the Town of Cherry Valley is hereby extended for a period of one year; now to expire on June 30th 2019, and

Further be it resolved: The estimated expenditure of the agreement shall be $64,059.12 for 12.6 lane miles for the 2016/2017 season and for the remainder of the term of the agreement, unless changed by a future update.

• No bites on the old pickup truck. If the old pickup truck does not sell it will be sent to auction.
• Superintendent Miles is getting quotes on a new truck. He would also like to get a plow for the new pickup truck. Motion made by Councilperson VanDerWerker to purchase a plow for the new pickup truck 2nd by Councilperson Cornwell. All in favor 5-yes 0-no
• Supervisor Garretson asked HS Miles to contact the County to address the lack of a shoulder on County Route 32.

Village:
• Mayor Guido gave an update on Village business.

Resolution 2018-10 NYS Retirement Standard Workday Form RS2417 will be posted for 30 days at the Town Clerk’s office and in the Town Clerk’s information Board in the Post Office. After 30 days Supervisor Garretson will submit the form to the State electronically.
Motion to accept Resolution 2018-10 as presented made by Councilperson Johnson 2nd by Councilperson Waterfield. Question and comments by the public present:
Mr. Minnig inquired about the status of the new road construction on Porath Road. Answer: It is a private road being put in by the new land owner. It is not a Town road. Basically the road is a private drive.

Mayor Guido stated the Village is working with the Mohawk Valley Land Bank to take over some of the blighted homes in the Village.

• Village started hauling the old burnt out house up to the Barringer Road old dump property. A discussion was held with the Board as to how to proceed. Highway Superintendent told the Village crew they cannot dumb this material in the dump and asked them to stop.

Resolution 2018-7 Otsego County Stream Maintenance Program
PROPOSED ACTION: To approve the financial support of $1,400 per year for a five year period for a total of $7,000 for the Otsego County Stream Maintenance Program.

WHEREAS, the Town of Cherry Valley agrees to participate in the Otsego County Stream Maintenance Program partnering with Otsego County and Otsego County Soil and Water Conservation District.

WHEREAS, the terms of the Otsego County Stream Maintenance Program between the Town of Cherry Valley, Otsego County and Otsego County Soil and Water Conservation District are effective January 1st, 2019 through December 31, 2023.

WHEREAS, the Town of Cherry Valley is aware that New York State is changing the way Consolidated Local Street and Highway improvement Program (CHIPS) money is disbursed, and

WHEREAS, New York State Consolidated Local Street and Highway Improvement Program (CHIPS) will only release funds once all invoices are paid and cancelled checks are provided to the State, and

WHEREAS, the Town of Cherry Valley will need to pay invoices in advance of receiving these funds; it is

RESOLVED, that the Supervisor, Thomas Garretson, is hereby authorized to execute a Revenue Anticipation Note, and it is further

RESOLVED, that the Town shall expend $125,000.00 on Revenue Anticipation Note.

Federal/State/County:
• Councilperson Cornwell asked if there are any updates on the dumpsters.
• Councilperson Waterfield stated she spoke with Karen Sullivan at the County and she is adamant something needs to be done by the Town to stop dumping household waste, construction waste and other waste into the recyclable bins. The Town is currently getting billed from the County for the illegal dumping into the recyclable bins. Ms. Sullivan suggested surveillance camera’s as well as getting local law enforcement involved in issuing tickets for the illegal dumping. The recyclable bins are placed there as a public service and they can be removed as well.

Question and comments by the public present:

Karl Kuemper resident of Baxter Road asks the Town Board what can be done about his neighbor who is dumping illegally on their property on Chestnut Street. He lives on Baxter Road and is concerned the illegal dumping is polluting his Beaver pond and causing problems with his wetland area. He feels something needs to be done to stop the illegal dumping.

Jordan Clements, district manager for Otsego County Soil & Water Conservation District made a proposal to the Town Board to be pro-active for future flooding issues the Town will encounter. His proposal is an Inter-Municipal Agreement. Purpose of agreement-Develop a Countywide Stream Maintenance Program. This would be an agreement for a 5 year period beginning January 1, 2019 and ending December 31, 2023. This would require a $2.00 tax increase per taxpayer in the Town of Cherry Valley.

• Supervisor Garretson received a call from a Company working with the CVSCSchool to install solar panels up at the school. About 20-25 acres of solar panels. Co. will keep Supervisor Garretson informed of the progress.
• CV Hardware asked to purchase a small piece of land from the Town that adjoins the CV Hardware’s property from the Town parking lot.

Community Center Alden Field and Park:
• Supervisor Garretson received an email from Jane Sapinsky of Cherry Valley Artworks asking if the Town will cover the rental fee for the Community Center rental for September 21 and September 22 Kite Fest usage. Motion made by Councilperson Johnson to cover the rental fee for CV Artworks kite fest rental in September, 2nd by Councilperson VanDerWerker. All in favor 3 yes 0 no.
• Cherry Valley Outdoor Games is this coming weekend which is also Father’s Day

Highway Department:
• Highway Superintendent Miles reported mine permit is completed and submitted.

Federal/State/County:
• County Rep Bliss reported on County Business.


Councilperson VanDerWerker asked Supervisor Garretson if he had heard anything regarding the Planning Board. A short discussion ensued. To be continued at a future meeting.
