The regular meeting of the Town of Cherry Valley Town Board was held on Thursday May 21, 2009 with meeting called to order at 7:05PM by Supervisor Garretson.

Motion made by Councilperson Johnson second by Councilperson Cornwell to pay the bills as presented. 3 yes 0 no motion carried.

Town share of monthly sales tax collected for the month of February 2009 is $5,257.07

Dog Control Officers reports for February and March are filed with the Town Clerk.

Primary Election Date: September 15, 2009
General Election Date: November 03, 2009

Correspondence received from Steve Eisenberg from Reunion Power.

New DECALS software runs off of Road Runner no longer need extra telephone line for dial up service.

Community Center/Alden Field:
Revenue for April is $710 and Expenses are $3,016.


Miscellaneous information:
Assessor to meet with the public and tentative roll-May 7, 11, 14 and 23.
Board of review will meet May 26 from 4-8PM.
2010 Census: Bureau well be visiting between April and July 2009
Maggie Milner has been chosen to go to Washington DC to represent the School for a scholarship opportunity for her poetry writing.

Health Center:
· Revenue for April $37,349 and Expenses are $35,346.
· Gary Schaeffer will be the custodial support for the Health Center

Town Facilities:
· William T. Ryan and Associates to complete new board room by 12-31-2009

Village:
Monthly Meeting Minutes are online @ cherryvalleyny.us
American Legion 5K Run/Walk will be held on Veteran’s Day weekend, November 07, 2009.
Restore NY Grant: Restoration of the Lafler Building progressing.

Visitor Center:
Permit issued by NYSDOT for Town use of State owned property.

Planning Board:
Supervisor Garretson received and e-mail from Liz Plymel asking not to be reinstated on the Planning Board.

Highway Department:
Rabies clinic scheduled for September 15 6-8PM
Received notice from the State re: bridge replacement on Route 166 slated in the near future.

Federal/State/County:
BOE new councilperson positions-one 4 yr term, one 2yr unexpired term

Land Use Committee:
Supervisor Garretson will try to contact Walter regarding the “draft document”

Alternative/Renewable Energy Committee:
Opened up the questionnaires they received back from residents.
85 questionnaires were sent out to 65 landowners and 57 were returned.

Questions and comments from the public present:

Andy Minnig asked that the adoption dates of the Wind Ordinances the committee reviewed be included in their review.

Flo Clapper asked why there are so many communication bills from different companies? She also asked can Cherry Valley develop its own wind project without big companies being involved.

Jack Palmenteri suggested attracting small investors.

There being no further business a motion to adjourn was made by Councilperson Cornwell and seconded by Councilperson Johnson.

Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Cornwell seconded the motion. The invoices and payments have been presented and accepted. All in favor 3 yes 0 no. Motion carried.

Town share of monthly sales tax collected for the month of May 2009 was $4,363.00.

Updates:

Community Center: Revenue for July is $150; Expenses for July are $4363
Soda machine revenue for 2009-Village Community Center Budget Review

Miscellaneous Information:
Supervisor Garretson received correspondence from Marion Holmes requesting a donation to the Roseboom Senior Citizens Club. Many members are from the Town of Cherry Valley. Supervisor Garretson made a motion to include a $100 donation be included in the annual budget, 2nd by Councilperson Johnson. All in favor motion carried.
Wal-Mart VAP donates a $250 grant back to the town for employees submitting paperwork showing 25 hours of volunteerism. Paperwork has been submitted to Wal-Mart.
Health Insurance Review. Supervisor Garretson sent a letter to Town Employees re: Health Insurance expenses for the upcoming budget year. This letter addressed different options he is looking at for the future budget.

Health Center:
Revenues for July are $29,266 and Expenses for July are $29,955.
Audit for years 2007 and 2008 has been completed

Town Facilities report:
The handicap ramp is being completed for the new entrance into the meeting room still under construction in the Community Center.

Facilities Corporation update given by Sam Dubben:
Things have been running smoother w/o the cost of running the daycare.

Village Shared Services:
Town and Village board minutes and info online at cherryvalleyny.us
Gates Cole letter to fellow business owners regarding the recent break in at their business.
Folk Fest for food is scheduled for August 13, 20, and 27

Visitor Center:
Lease agreement is ready to be signed by town and NYSDOT. Kevin Yerdon will be surveying the lot.
$345,200 in County, State and Federal Grant Funding all renewed and secure

Planning Board:
Walter Buist, Planning Board Chairman, stated Planning Board members will be able to pick what courses they would like to be re-trained on.

Highway Department:
Rabies clinic will be held on September 15 from 6-8PM
Ed Harvey, village trustee, Marty Fields, Fire Chief, would like to do an open house for the public to see the newest trucks that are being purchased in the town and the fire department. Supervisor Garretson also inquired about the Moving Wall display information. Mary Beth will get this information to Tom.

Federal/State/County:
· County Rep Sam Dubben reported the County Board voted to not man the information booths.
· The county is running behind on sales tax revenue.
· County is hoping to operate The Manor on a break-even system.
· Working on the equalization rate. Cherry Valley is at the lowest rate currently in the County.
· Scott Fickbaum is currently asking for letters of support for a grant for the watershed

Land Use Committee:
Draft has been presented to the Supervisor, which he will review. Public Hearing will be scheduled at the next meeting of the Town Board.

Alternative Renewable Energy Committee:
Chairman, Mark Cornwell reports he is currently plugging all the wind laws he has gathered from NYS into a spread sheet.

Eric Miller, Executive Director of OCCA handed out packets of information re: Government jurisdiction regarding gas drilling. He also handed out information on addressing current local laws in regards to local road usage, noise ordinances and taxation. Mr. Miller gave a presentation touching on the aforementioned topics including the burden falls on a Community to prove they are not generic to NYSDEC with regards to historical as well as agricultural resources for examples. Mr. Miller also encouraged the Town to support the local Assessor.

Question, comments and concerns by the public present.
Many of the public present had questions for Mr. Miller. Supervisor Garretson asked for adjournment so questions could be asked and discussions could be held w/ individuals as needed.

Councilperson Cornwell made a motion to adjourn Councilperson Johnson second the motion.
