• Board of Directors met and decision was made not to rent or lend out tables and chairs.
• Using the floor covering on half of the gym floor when a party or event is taking place where food and drink will be served.
• Locks will be re-keyed and a $25 deposit will be collected.

Proposed action:
Purchase of a new Freight-liner Dump/Plow Truck for the Town of Cherry Valley

Motion to adopt Resolution 2016-8 is made by Councilperson Barown 2nd by Councilperson Johnson All in favor 4 yes 0 no. Resolution 2016-8 New Freight-liner Truck is duly carried.

Motion to adopt 2017 Budget as presented is made by Councilperson Cornwell and 2nd by Councilperson Barown Motion carried.

Question and comments by the public present:

Andy Minnig asked a question regarding the Community Center Expense and Revenue reported on Page 2 of the budget and also the cost of running the Community Center on page 3. Community Center was used more and building maintenance is lumped into other Town Building maintenance expenses such as utility costs.

The Board moved into Executive session.

Councilperson Barown announced he will be running for Town Justice as a write-in. He checked with the State and he does not have to step down from his current roll as Councilperson, however the Town Board will have a vacancy after the Elections beginning in January. The vacant position will be advertised in January 2017.

Preliminary Budget is presented to the Town Board and is available for view at the Town Clerk’s office during regular business hours.

PUBLIC HEARING FOR LOCAL LAW 2016-1 2017 PROPERTY TAX CAP LEVY OVERRIDE is opened at 6:55PM with a motion from Councilperson Barown and 2nd by Councilperson Cornwell. 5-yes 0-no

Public present asked for an explanation for the tax cap levy override.

The Board explained this is required by the State of New York if the Town Budget exceeds a certain level the Town has to have a local law to override the cap in order to make budget. The State put this in place approximately 4 years ago and every year the Town passes a local Law to override the cap if need be.

Supervisor Garretson stated DOT has contacted him and they are interested in ownership of the railroad bridge that goes over State Route 20. The bridge is a hindrance for larger vehicles transporting large structures and or other large equipment on Route 20.

Federal/State/County:
• County Rep Dave Bliss attended the Town Board meeting.

Resolution 2016-6 of the Cherry Valley Town Board

PROPOSED ACTION: Create an additional account at NBT Bank to be used for the revenue and expense transactions of the Cherry Valley Health Center

WHEREAS, the Office of the State Comptroller has recently completed an audit of the Town of Cherry Valley, and

WHEREAS, the OSC has recommended that the Town should segregate the accounting records of the Cherry Valley Health Center, and

WHEREAS, NBT Bank has requested the town board to pass a resolution allowing the town supervisor to open a new bank account for the Cherry Valley Health Center, and

NOW, THEREFORE BE IT RESOLVED, Supervisor Garretson will open a new account at NBT Bank to be used exclusively for the Cherry Valley Health Center transactions.

Motion to accept 2016-6 as presented made by Councilperson Cornwell and seconded by Councilperson Waterfield. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Cornwell and Councilperson Waterfield-yes Councilperson Barown-abscent. 4-yes 0-no Resolution 2016-6 is duly carried.

RESOLVED, that the Supervisor, Thomas Garretson, is hereby authorized to execute a Revenue Anticipation Note, and it is further

RESOLUTION 2016-5 of the Cherry Valley Town Board

PROPOSED ACTION: Snow and Ice Contract Extension 2016/2017-between NYSDOT and the Town of Cherry Valley

WHEREAS, the NYSDOT and the Town of Cherry Valley have entered into agreement #D010680 entitled “Indexed Lump Sum Snow and Ice Agreement between the New York State Department of Transportation and the Town of Cherry Valley dated January 14th 1997, and

WHEREAS, the present term of the agreement as previously extended, expires June 30th 2016, and

WHEREAS, the said agreement provides for an annual update of the estimated expenditure to be determined by NYSDOT, and

NOW, therefore be it resolved: The aforementioned agreement between the NYSDOT and the Town of Cherry alley is hereby extended for a period of one year; now to expire on June 30th 2017,and

FURTHER be it resolved: The estimated expenditure of the agreement shall be $5,035.65 per lane mile for 12.6 lane miles of a total of $63,449.17 for the 2014/2015 season and for the remainder of the term of the agreement, unless changed by a future update.

• Tracy Donavan has expressed an interest in filling the empty Justice seat. The Board will look into how to appoint Tracy to the vacant Justice seat.
• Cherry Valley Artworks sent a Thank you for the donation. Artworks also sent a notice stating the County Board gave Artworks $3,500 towards the Kite Festival in previous years and this year the contribution has been reduced to $750. Artworks were notified of this reduction 5 months before the Kite Festival. Artworks are asking if the Community Center fee could be waived this year. Councilperson Barown made the motion to waive the fee this year seconded by Councilperson Cornwell. Motion carried all in favor 5 yes 0 no.

Community Center/Alden Fields and Park:
• Swim program will be held at Public Landing in Springfield
• The Gym will be closed for the month of August to do some much needed maintenance. Resurfacing the gym floor, minor repairs and painting.
• The rug in the conference room has been vacuumed.

Town Facilities:
• Association of Towns put the Energy out to Bid and Constellation Energy won the bid again for this year.

Health Center:
• Kevin Flint is redoing the sign for the Health Center and he inquired how the wording will be for the sign. There was some discussion among the Board and a final decision was not reached yet. Supervisor Garretson will get back in touch with Kevin with the wording.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Mayor Flint is present at tonight’s meeting and he gave an update on Village business.

Highway:
• New truck is still in Syracuse
• Councilperson Waterfield asked about what Stihl product the Town Highway would like. Superintendent VanDerWerker stated the backpack blower would be nice.

Andy Minnig thanked the Board for waiving the Community Center rental fee on behalf of Artworks for the Kite Festival.

Now, therefore be it resolved, to start the process, eligible municipalities must pass a resolution requesting assistance and forward that resolution to FRB

Town Facilities:
• Supervisor Garretson received a call from Town Attorney, Will Green, regarding the appraisal amount for the Gates Cole building. Attorney Green is going to draft a letter stating the amount will be locked in for the next 3 years as long as the building remains the same. If improvements or additions are made to the building then a reevaluation will be warranted. Gates Cole will also not receive back taxes.

Community Center/Alden Fields and Park:
• Biddy basketball is going well

Health Center:
• Supervisor Garretson and Maureen Kuhn, FNP at the Health Center had a meeting recently with Frank Partenza, Frank Panzerella, Steve Hennigan, Mark Horton and Joe Sellers to see if Bassett can help with the Health Center operations with regards to billing and capturing revenue. They all agree they want to keep the Cherry Valley Health center as the Cherry Valley Health Center. Because the CVHC is a rural health center this separates them from Bassett being a regional Health Center in terms of billing for services.
• Councilperson Barown stated the recent fundraiser for the Health Center brought in $5,600

Misc. Updates:
• Justice Wickwire has back files that need to be shredded. Shredding of these documents will be done by a professional shredding service.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Mayor Flint reported things are running smoothly so far this winter with the mild temperatures.

Town Planning:
• Tavis Austin has moved from the area. If the Town needs environmental consulting work we will have to find someone else. Councilperson Waterfield states the OCCA, Otsego County Conservation Association, has hired a replacement for Tavis his name is Danny Lapin, environmental planner.

Highway:
• Still waiting for new truck.

Federal/State/County:
• Supervisor Garretson received an email from Dave Bliss, County Rep stating he won’t be able to attend many meetings as Roseboom and CV have the same meeting nights.
• Councilperson asked Supervisor Garretson to contact Andy Minnig regarding the bed tax revenue needs to come towards CV.
• Workman’s comp is going to be handed over to the Town’s to be responsible instead of the County.

• Supervisor Garretson asked Village attorney Dennis Laughlin if he and the Town Attorney, Will Green, have been in contact regarding where we stand on the Gates Cole issue. Councilperson Barown stated he had proof read through the document and he printed 3 hard copies; one copy can be filed with the County, one copy will be mailed to Gates Cole and one copy for the Town record. Then the Town waits to hear back from Gates Cole to see if they will accept the appraisal performed by Paul Hatzinger or go to court. The Town Attorney, Will Green, is going to make it very clear Gates Cole would not be getting any back taxes back and they should accept the appraisal presented. If Gates Cole does not accept the appraisal then the matter will go to court.

Town Planning:
• Motion made by Councilperson Barown to appoint Lorraine Bosma to the Planning Board and seconded by Councilperson Waterfield 4 yes 0 no

Community Facilities Corp:
• February 6 there will be a sweetheart dinner.
• Councilperson Barown stated the recent auction co-hosted with the Chamber of Commerce and it was a big success.

Highway:
• Fire Department is asking for a list of seasonal roads.

The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.

If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.

Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.

96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Budget Officer is authorized to pay employees, insurance, utility, communication and any other due invoices prior to the review and approval of the town board.

The Superintendent of Highways is authorized to purchase equipment and replacement parts prior to the review and approval of the town board, not to exceed $3,500

The Superintendent of Highways will provide the Supervisor with overtime hours per highway employee no later then 4pm on Wednesday of the payroll week.

The Town Supervisor will provide the Community Center Director with an annual budget and provide monthly updates of revenue and expense.

The Cherry Valley Community Center Director will be responsible for organizing and conducting an annual meeting with all parties involved with the use and maintenance of the Community Center and Alden Fields.


The Town Supervisor will serve as Chairman of the Cherry Valley Health Center Board.

The Town Supervisor will provide the Cherry Valley Health Center Board with an annual budget and provide monthly updates of revenue and expense.

Op-Out Health Insurance Program is available - proof of other health insurance coverage is required - op-out payment is based on the single package contract rate premium for the year.

Disability payment to employee is $510 / wk

Death benefit - payable to the estate of the employee is $100,000
