Miscellaneous Information presented to the Town Clerk by Supervisor Garretson is as follows:
• Town share of monthly County sales tax collected for the month of OCT 2015 is $5,850.05
• Otsego County Deputy Sheriff’s donated $250 for Little League equipment
• Otsego County Deputy Sheriffs PBA donated $250 for Little League equipment

Community Center/Alden Fields and Park:
• Rentals have been up for the Community Center. Biddy Basketball has started

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Facilities Corp:
• Chris Barown reported the Chamber Auction will take place tomorrow night. Half the proceeds will go towards the Corp.
• Chris also reported the Corp. heard back from the Fenner Foundation for programming for the music and art supplies run by Carl Waldman a donation of $3,000.

Highway Department:
• Truck has not been ordered Highway Superintendent is still waiting on some more specs for the truck.
Federal/State/County:
• Superintendent Garretson handed out a SEQR done by the State for preventative maintenance paving of Route 20
• Resolutions passed by the State.
• Training programs for new officials

Motion to move into Executive session is made by Councilperson Barown and second by Councilperson Cornwell. Roll call vote is taken Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Waterfield-yes 5 yes 0 no.

Motion is made to come out of Executive session is made by Councilperson Barown and second by Councilperson Waterfield.

• Health center Budget is a little off. Supervisor Garretson and Maureen Kuhn are going to contact Bassett to look into better billing/collecting programs for the HC reimbursements coming in quicker.

Misc. information to the Town Clerk:
• Sales tax for Sept 2015 $8,720.02
• Councilperson Barown asked the question why is the County still having budget issues after the sale of The Manner? Supervisor Garretson stated the current owner’s Focus is having issues financially.

CV Facilities Corp:
• Richard Saba contacted Supervisor Garretson regarding the furnace fund raiser hasn’t raised enough to cover the cost and the Facilities Corp will be seeking a loan from the Bank. Appraiser will need to get in the whole building, including the Gym to do the appraisal. Councilperson Barown stated the loan was approved.
• Councilperson Barown also reported on the Fenner Foundation in the past had donated to the Old School. Councilperson Barown will be pursuing this money through the Fenner Foundation.
• Chamber of Commerce will be doing a Holiday Auction on December 11

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Town Planning Board:
• Supervisor Garretson handed out information regarding Planning Boards in general. Town’s are not required to have a Planning Board. The Planning Board is a work in progress in terms of updating members and reorganization of the Board.

Highway Department:
• Inspection report given to Highway Superintendent VanDerWerker by Supervisor Garretson
• Motion to allow the Highway Superintendent VanDerWerker to proceed with the purchase of a new Freightliner to replace the GMC is made by Councilperson Johnson second by Councilperson Barown. Motion carried.

Discussion held by the Board regarding Workman’s Comp tax coming back to the Town tax from the County tax. This cannot be put in the budget until Supervisor Garretson gets a notice form the County Reps stating the County will not be covering the Workers Comp tax.

2016 Town of Cherry Valley Budget-Preliminary Budget is presented to the Board. Motion to accept the 2016 Budget as presented is made by Councilperson Barown and second by Councilperson Cornwell. All in favor 5 yes 0 no

Town Resolution 2015-9 Re: Dominion New Market Project
The Federal Energy Regulatory Commission concludes that this project would not constitute a major Federal action or any significant impact. It is resolved that the Town of Cherry Valley stands in solidarity with the Town’s of Minden, Canajoharie, Otsego, Roseboom and the Village of Fort Plain in the following earnest requests, made in the interest of protecting local and regional air quality, and the public health and well being of these communities.
Motion to accept Resolution 2015-9 Dominion New Market Project Councilperson Barown second Councilperson Waterfield. Roll call vote Supervisor Garretson-yes Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Waterfield-ys 5 yes 0 no Duly carried.

• Received a letter from Richard Saba asking for any donation the Town can make towards the furnace repair.
• Chamber of Commerce will be splitting their fund raiser money from the Holiday Auction with the FC.

Village:

• Councilperson Barown asked if the Town has agreed to provide dog control services to the Village. Does the Town DCO have jurisdiction in the Village since he is a paid Town DCO? Village Attorney Dennis Laughlin stated there should be a memorandum of understanding of the Town will be responsible for providing the joint DCO service to the Village. Supervisor Garretson will contact Town Attorney Green to provide this written memorandum for the next meeting.

Town Planning Board:
• There are currently two positions vacant on the Town Planning Board
• Motion to appoint Tracy Donavan Laughlin to the Town Planning Board is made by Councilperson Barown and seconded by Councilperson Cornwell. All in favor 5-yes 0-no

Resolution 2015-8 Annual Audit of 2014 Town Justice Court Records
Motion to accept Resolution 2015-8 as presented is made by Councilperson Cornwell and seconded by Councilperson Waterfield. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes Councilperson Cornwell-yes, and Councilperson Waterfield-yes 5-yes 0-no Resolution 2015-8 duly carried.

2016 Tentative Town of Cherry Valley Budget as presented to the Town Board for review. Motion to accept the tentative budget is made by Councilperson Barown seconded by Councilperson Johnson. Motion carried.

There will be a Public Hearing at the November 12 meeting for the Preliminary Town Budget for 2016 starting at 7:00pm.

Jane Sapinsky representative from Artworks spoke to the Board about Artworks events that have brought in people to the Town for events Artworks has sponsored throughout the years. Artworks would like the Town to consider a monetary donation to Artworks for them to remain sustainable. Artworks leases the building from the Village and Artworks maintains the building.

• Dennis Laughlin is looking for the Seasonal Road Law from the Town
• Thomas Beard from the Governor’s storm recovery office called asking for the Town’s procurement policy.
• Surveys went out for the blasting. Still waiting to hear back from the Company.

Resolution 2015-4 CHIPS Revenue Anticipation Note:

WHEREAS, the Town of Cherry Valley is aware that New York State is changing the way Consolidated Local Street and Highway Improvement Program (CHIPS) money is disbursed, and

WHEREAS, New York State Consolidated Local Street and Highway Improvement Program (CHIPS) will only release funds once all invoices are pad and cancelled checks are provided to the State, and

WHEREAS, the Town of Cherry Valley will need to pay invoices in advance of receiving these funds; it is

RESOLVED, that the Supervisor, Thomas Garretson, is hereby authorized to execute a Revenue Anticipation Note, and it is further

RESOLVED, that the Town shall expend $125,000.00 on the Revenue Anticipation Note.

Motion to accept Resolution 2015-4 as presented is made by Councilperson Cornwell and seconded by Councilperson Barown. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Cornwell-yes, Councilperson Barown-yes, Councilperson Johnson-yes and Councilperson Waterfield-yes 5 yes 0 no Resolution 2015-4 is duly carried.

Supervisor Garretson submitted a letter to the Board from the State Comptroller stating the Town is fiscally stressed. Because of the 2% tax cap the Town will continue on this path until such a time taxes need to be raised.

• The Town Attorney inquired about the Town’s dog warden and does his jurisdiction include the Village of Cherry Valley because the Village doesn’t have a Village Dog Warden.
• The Village attorney spoke on this topic in term of a shared service has not been discussed between the two municipalities. The two attorneys have spoken regarding this issue and they will prepare a proposal for both boards in the near future.

Town Planning Board:
• Supervisor Garretson received a letter of resignation from the Planning Board Chairman, Walter Buist

Highway Department:
• New truck is in
• Supervisor Garretson and Highway Superintendent VanDerWerker met with a Risk Control management person from the insurance company to make sure policies are in place etc.
• The Highway Superintendent will put together a driver policy
• Switch for the fuel pump
• Job descriptions
• Fire Extinguishers

Installment Bond Resolution can be viewed at the Town Clerk’s office during regular business hours, Wednesday evenings 7-9PM or Saturday mornings 8-11AM at 2 Genesee Street Cherry Valley, NY County of Otsego.

Motion made by Councilperson Cornwell to accept Resolution 2015-3 Purchase of a new Volvo /Dump Truck for the Town of Cherry Valley and seconded by Councilperson Waterfield. • Supervisor Garretson was contacted by Jackie Flint regarding Wal-Mart contributing food to the food pantry. Chris Barown needs to find out more detail regarding the contributions in terms of food and or money contributions with regards to the Episcopal Church being the sponsoring church.
• The 3rd annual spring auction is scheduled for Saturday May 2 at the Café.

Councilperson Waterfield inquired about the speed limit reduction sent to the State for Count Route 54. Supervisor Garretson presented a letter from the State letting us know the request was declined.

Resolution 2015-2 Hazard Mitigation Grant Program

WHEREAS, The Town of Cherry Valley, with the assistance from H2O Partners, Inc., has gathered information and prepared the Otsego County Hazard Mitigation Action Plan (HMAP); and

WHEREAS, the HMAP has been prepared in accordance with the disaster Mitigation Act of 2000; and

WHEREAS, The Town of Cherry Valley is a local unit of government that has afforded the citizens an opportunity to comment and provide input in the Plan and the actions in the Plan; and

WHEREAS, The Town of Cherry Valley have reviewed the Plan and affirms that the Plan will be updated o less than every five years;

NOW THEREFORE, BE IT RESOLVED by Town Board that Town of Cherry Valley adopts the HMAP as this jurisdiction’s Natural Hazard Mitigation Plan, and resolves to execute the actions in the Plan.

Motion to accept Resolution 2015-2 Hazard Mitigation Grant Program as presented made by Councilperson Barown and seconded by Councilperson Cornwell. Roll call vote is taken:

Town Clerk requests an answering machine for the Town phone so she does not have to use her personal phone for Town messages. Councilperson Barown will contact Cornerstone to see if voicemail can be placed on the current line for the Town Clerk’s phone number which is 264-8140. This is also used as the fax number.

• Sales tax for the month of NOV $5,339.52
• Thank you card with photos enclosed received from the Girls biddy basketball team thanking the board for their new uniforms.

Community Center/Alden Fields and Park:
• Biddy basketball is going well
• Looking to refinish the gym floor soon.
• Storm windows have been ordered for the front windows
• Discussion ongoing about building a vestibule for the front doors
• Also looking into replacing the lights with more efficient lights

Health Center:
• Cindy Campbell has taken another job

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Town Planning:
• The Town Tax collector needs a new computer as the one she is currently using needs to be replaced due to the County doing upgrades to their software.


Highway:
• Received a letter from NYSDOT regarding the speed limit reduction request on County Road 32. The speed limit has been reduced to 50mph.
• The Town Hwy is down a truck. The new truck should be arriving early spring.

The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.

If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.

Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.

96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Town Supervisor will serve as the Town Budget Officer.

The Budget Officer is authorized to pay employees, insurance, utility, communication and any other due invoices prior to the review and approval of the town board.

The Budget Officer will produce all paid invoices with attached check stubs for monthly town board audit review and approval.

The Budget Officer will provide proof of any voided, damaged or destroyed check.

The Superintendent of Highways is authorized to purchase equipment and replacement parts prior to the review and approval of the town board, not to exceed $3,500

The Superintendent of Highways will provide the Supervisor with overtime hours per highway employee no later then 4pm on Wednesday of the payroll week.

The Town Supervisor will provide the Community Center Director with an annual budget and provide monthly updates of revenue and expense.

The Cherry Valley Community Center Director will be responsible for organizing and conducting an annual meeting with all parties involved with the use and maintenance of the Community Center and Alden Fields.

The Town Supervisor will serve as Chairman of the Cherry Valley Health Center Board.

The Town Supervisor will provide the Cherry Valley Health Center Board with an annual budget and provide monthly updates of revenue and expense.

Tavis Austin – Principal Planning Consulting Services will provide the Town Board and the Planning Board with services as needed.

The 2015 fringe benefit package for full time town employees is as follows

2 weeks vacation for 1 to 10 years of service
3 weeks vacation for 10 to 20 years of service
4 weeks vacation for 20 or more years of service

12 holidays - can be used on a floating basis – no carry over
5 personal days - can be used as needed - no carry over
10 sick days - can be used for sickness only - maximum carry over of 180 days

Medical, dental and vision insurance coverage after 6 months of employment

Cintas work clothes provided daily to the highway department employees

Op-Out Health Insurance Program is available - proof of other health insurance coverage is required - op-out payment is based on the single package contract rate premium for the year.

NYS Retirement - 3% employee contribution of salary for 10 years is required

Disability payment to employee is $510 / wk

Death benefit - payable to the estate of the employee is $70,000

Motion to accept Resolution 2015-1 Organizational Meeting made by Councilperson Johnson and seconded by Councilperson Waterfield. Roll call vote is taken: Supervisor Garretson-yes Councilperson Johnson-yes Councilperson Brown-yes Councilperson Waterfield-yes 4-yes 0-no Resolution 2015-1 is duly carried.

Question and comments by the public present:
Aaron VanBuren, Captain of the Cherry Valley Emergency Squad, is here representing the Emergency squad as they are going to be hosting an open house in May for EMT week. They have many events planned that may require a road closed off and he is asking for the Town Board to sponsor the event so that the Squad is in compliance with any laws in terms of closing off a road and or hanging signage over Main Street advertising the event. The road in question is a Village road so this would have to go to the Village Board. Would the Town be interested in contributing to any signage to advertise the event?

Community Center/Alden Fields and Park:
• Biddy Basketball has started
• Work detail done last Tuesday-carpet and walls cleaned in the conference room. Under the bleachers cleaned and new score board installed. Work performed by Community Center Board members; Helen Stiles, Don Brigham, Mary Beth Flint, Raymond Freer as well as volunteers from the biddy basketball program, BJ Whiteman, Emma Whiteman, Michael Freer, Matthew Freer, and our Building maintenance person-Jeff Stiles. Community volunteers, Scott Flint, Kevin Flint, Mayor and Janet Brigham.
• Councilperson has been in contact with Jeff Stiles regarding replacing the lights in the Gym with more energy efficient lights.

Misc. Updates:
• Councilperson Barown has been asked to sit on the Food Pantry Board to see this service continue for people in the surrounding area.
• Received the audit report from the State Comptroller. SCO recognized the Town is financially stressed. Suggested raising taxes. Supervisor Garretson as well as Councilperson Barown spoke with Dan Crowell regarding the audit and he to suggested raising taxes. Supervisor Garretson duly noted the suggestion. Councilperson Cornwell pointed out the same State government is asking us to stay under the 2% tax cap and then they give us unfunded mandates such as raising the contribution to the NYS retirement and then audit us and tell us we are fiscally stressed.
• Dorothy Johnson the Town Tax Collector states she needs an updated computer to do the Town Taxes.

Health Center:
• Supervisor Garretson met with the new part time employee hired, Danielle Easton. She likes her new position.
• Health Center end of the year report is on file in the Town Clerk’s office.

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Highway:
• Ed VanDerWerker isn’t sure he is part of the Association of Towns. Supervisor Garretson states he is. The Town pays the dues yearly.
