Public Hearing November 10, 2011


Public Hearing for proposed Local Law 2011-4 Override Tax Levy Law was opened at 6:58PM.

Public comment:
Richard Mark opposes the current proposed Law. He feels the current budget cap is adequate. The economy is not getting better and this is not the time to increase the levy to exceed the 2% cap once this law is passed.

Town Attorney Green stated if the State determines the budget is over 2% then the Board will have a safety net for the Town.

No further comments from the public present.

Public Hearing for the 2012 Preliminary Budget is opened at 7:05PM.
Richard Mark stated the Community Center is losing money and costing the Town to operate. He does not wish to see the Center Closed, but merely pointing out the money situation.

Matt Utter asked what fund the Re-eval was paid from. Supervisor Garretson answered the General Fund.

Miscellaneous updates:
• County Equalization Rates for 2012 Tax Roll list presented to the Town Clerk. Cherry Valley is at 100%

Health Center:
• 2012 Adopted Budget $425,000 (2011 adopted budget $415,000)

Village:

Town Planning:
• Otsego Soil and Water monitoring water quality is being done at 50 county testing sites

Highway Department:
• FEMA-3341-EM Tropical Storm Irene-Designation and Assistance update. Highway Superintendent Ed VanDewerker stated the Town’s estimated cost for repairs is approximately $60,000.

Proposed Local Law 2011-4 Local Budget Override Law is presented to the Board. Motion to accept the proposed Local Law 2011-4 is made by Councilperson Barown and seconded by Councilperson Cornwell. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes.
5 yes 0 no Local Law 2011-4 is duly enacted.

Preliminary Budget is presented to the Board. Motion to accept the Budget as presented by Councilperson Johnson. Seconded by Councilperson Horvath. 2012 Town of Cherry Valley Budget passed.

Resolution 2011-9 County Snow and Ice Agreement for 2012 is presented to the Board. Motion to accept Resolution 2011-9 is made by Councilperson Barown. Seconded by Councilperson Johnson. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no. Duly carried.

Resolution 2011-10 American Tower Corporation is presented to the Board. A discussion ensued between the Board and the Town Attorney, Lynn Green, regarding the inactive Tower assessment being reduced and what happens if the Tower is sold. Attorney Green spoke with the Assessor about the inactive Tower. The assessment could be reduced. Attorney Green requires an authorization letter from the Board to sign a stipulation for the entry of the court order. American Tower Corporation will continue to pay taxes on the Tower. If the Tower is sold substantially above the assessment there will be a new appraisal.
Motion to accept Resolution 2011-10 made by Councilperson Horvath, seconded by Councilperson Barown. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no Duly carried.

The aforementioned Local Law, 2012 Budget and Resolutions are filed in the Town Clerk’s office for public viewing.

Question and comments from the public present:
Matt Utter inquired about Councilperson Horvath’s eligibility to still be active on the Town Board in regards to his current residency? The potential vacancy has been advertised for the Spring of 2011.

Kevin Flint inquired if the Town has any By-Laws to refer to regarding the issue of impending vacancies on the Board?

A discussion ensued among the public present. Attorney Green will have to research the issue.
A motion is made by Councilperson Johnson to go into Executive session. Seconded by Councilperson Cornwell.

Motion to leave Executive session and adjourn the meeting made by Councilperson Barown and seconded by Councilperson Cornwell.

Town Planning:
• Tentatively budget $3,000 to retain Tavis Austin Consulting Service.

Highway Department:
• Delta Road Use Agreement-Councilperson Cornwell deferred to Lynn Green to discuss SEQR process. Mr. Green stated it is unnecessary to do SEQR process. At this point there is no need to push through a Road Use Law.
• Highway files and equipment will be relocated from the Town Court area.
• FEMA-3341-EM Tropical Storm Irene-Designation and Assistance update. Highway Superintendent Ed VandDewerker stated FEMA will be coming for a site visit in the near future. The time line for receiving funding from FEMA can take weeks.
• A motion was made by Councilperson Barown to give permission to trade the 87 Mac truck to Town of Middlefield for 8 new truck tires. Seconded by Councilperson Horvath. Motion carried.

Town of Cherry Valley 2012 Preliminary Budget presented. There will be two public hearings scheduled before next Town Board meeting in November. Public hearing number one will be for a proposed local law to override 2 % tax levy. Public hearing number two will be for the 2012 Preliminary Budget.

  • Supervisor Garretson called the NYSDOT inquiring about the Snow and Ice Adjustment check for $37,000.  The Highway Department is also expecting a check from the CHIPS program in the amount of $60,000.
Community Center/Alden Fields and Park: 
  • Reservations are coming in at a steady pace
  • There will be a work detail on September 17 to fix the riverbank and clean up the debris from the flood.
  • Primary Day is September 13 scheduled in the Conference room.
Village:
  • Town and Village board minutes online @ cherryvalleyny.us
Visitor’s Center: 
  • Waiting for feedback from Foit-Albert regarding the lack of bids on the Visitor Center project.  The project will be opened for re-bid in the spring.
Town Planning:
  • Councilperson Cornwell was unable to attend the Road Use meeting with Delta last month.  Councilperson Cornwell did speak with Bill Isley, Supervisor for Springfield, and found out the State will be the lead agency with this particular Road Use issue.  Most likely each Town will have to go through the SEQR process and use their own attorney.  Money paid to Delta will or should be refunded. Cherry Valley will have to pass our own Local Law in terms of Road Use.
Highway Department: 
  • Delta Road Program-Joint SEQR process with County revised.
  • Highway Files and Equipment will be relocated from Town Court Area.

Resolution 2011-6 Snow and Ice Contract Extension 2011/2012 between NYSDOT and Town of Cherry Valley presented.  Supervisor Garretson made a motion to approve Resolution 2011-6, seconded by Councilperson Barown.  Roll call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no Duly carried. 

Resolution 2011-7 Annual Audit of Town Justice Court Records presented:  Councilperson Barown made a motion to approve Resolution 2011-7, seconded by Councilperson Horvath.  Roll call vote was taken; Supervisor Garretson- yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes.  5 yes 0 no.  Duly carried. 

Resolution 2011-8 Justice Court Assistance Grant application presented.  Councilperson Cornwell made a motion to approve Resolution 2011-8, seconded by Councilperson Johnson.  Roll call vote was taken; Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes and Councilperson Horvath-yes.  5 yes 0 no.  Duly carried. 

The tentative budget for 2012 is reviewed.  A public hearing will be held before the November Town Board meeting at 7:00PM.  The Preliminary Budget will be presented at the October Town Board meeting.

One (1) sealed bid was received for the Visitor Center construction. This bid was from Boland’s Excavating and Topsoil, Inc. 1403 Milburn Drive Conklin, NY 13748.

The Town Board rejected the bid. The project will need to be re-bid at a later date.

A discussion ensued with Ken Baldwin, architect with Foit-Albert Architects. Mr. Baldwin will need to take a look at the project and follow up with the Town Board.

A motion was made by Councilperson Horvath to close the meeting and seconded by Councilperson Cornwell. Meeting closed at 8:35PM.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
• Budget reviewed as well as NBT Account balances.
• Town share of monthly County sales tax collected for the month of May 2011 is $8,088.97.
• Daily Star ad for the Completion of the Final Assessment Roll
• Councilperson Barown met with Tim Powers of Cornerstone Telephone Company to review why our phone bills have increased over the past month and Mr. Powers stated phone usage at the Health Center is up.
• Mr. Powers and Councilperson Barown also discussed companies that do credit card transactions. This would be useful for the Town Court system and the Town Clerk to be able to collect fees via credit card transactions.
• Justice Wickwire is looking into a $30,000 grant for renovations to the Court Room at the Town Barn.

Community Center/Alden Fields and Park:
• The Opera’s rehearsals have ended and a bill will be sent to them soon.
• There are a number of reservations coming up.
• There will be a Community Dinner in the fall to benefit the CV Library.
• Councilperson Barown spoke with Jeff Stiles, buildings supervisor, regarding thermo storm windows to put on the windows in the gym. He will be getting quotes from Bruce Hall.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Folk Fest for Food has begun and will be August 11, 18 and 25 in the bank parking lot.

Visitor’s Center:
• John Sagendorf is the contact for NYSOGS (Office of General Services) for the general service signs for the Route 20.
• Building proposal bids will be opened on August 25 at the Community Center at 7:00PM.

Town Planning:
• 2012 Budget Workshop will be August 25th at the Community Center at 7:15PM
• Consider including Tavis Austin in the 2012 budget as a resource for Town Planning.

Highway Department:
• Councilperson Cornwell gave an update on the Delta Road Use program. Delta has been paid for the highway survey and Councilperson Cornwell has contacted Delta via e-mail for updates on where they are in the process. Eleven of fourteen towns have signed on with Delta to use their attorneys for the model Law. A question was raised whether or not the town will have jurisdiction on who can drive on a particular road. Discretionary authority may want to think about SEQRA for every permit issued. Recommend using a Local Law and using the Town Attorney to pursue or hiring Whiteman, Osterhoudt and Hannah the cost to join is $1,300. The Town could come up with a Road Use agreement.
• There will be a meeting on August 16 at The Meadows with Delta and the County Planning Board regarding the draft Road Use Law.
• Rabies Vaccination free clinic will be September 6th from 6-8PM at the Town Barn/Highway.
• Highway Files and Equipment will need to be relocated from the Town Court Area.

Question and comments from the public present:

Beth Rosenthal, Town Clerk for Roseboom, stated the Town Board may want to consider sending a message to the County regarding not using flow back fluid on the roads during the snow and ice removal or using it to control dust on dirt roads.

Andy Minnig stated legislation was recently passed called Empower New York. This will take away the authority from municipalities to place power plants. The Town Board may want to consider sending a resolution to the Governor.

• NYS 2% Property Tax Cap-Town Budget Review will be at the August meeting. If the Town maintains the 100% equalization rate we will get back $5 per parcel.

Highway Department:
• Delta Road Preservation Program. Joint SEQR process with the County. Supervisor Garretson would like Councilperson Cornwell to work on the Road Preservation Program.
• Free Rabies vaccination Clinic is September 6 from 6-8PM at the Town Barn, Main Street.

Federal/State/County
• The Land Use Document was presented to the County Planning Board, which gave their approval to adopt the CV Land Use Law, before they disbanded.

Resolution 2011-5 Amendment to NYSDOT Snow and Ice Contract was read. Motion to adopt Resolution 2011-5 Amendment to NYSDOT Snow and Ice Contract was made by Councilperson Cornwell and seconded by Councilperson Johnson. Roll Call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes, and Councilperson Horvath-yes. 5 yes 0 no. Duly carried. Dennis Laughlin wanted to thank the Highway Department for blacktopping Nielson Road.

Karina Gable asked how the Board would handle some one with land who wanted to pursue a Business in their home. Walter Buist Planning Board Chairman commented these would have to be looked at individually.

Supervisor Garretson recommends the Comprehensive Plan adopted in 2007 be reviewed every 5 years.

Kathleen Taylor thanked the Board for protecting the Town with this Law.

• Right of Way Clearance Certificate to NYSDOT. The project is moving forward

Town Planning:
• George Cade and Kassy Cade-Laymon reported the Board of Review went well. Approximately 17 people appeared before the Board. There is one issue still pressing.
• Springfield will be going forward with their reevaluation process.
• The Draft Local Land Use Law will be presented to the Otsego County Board meeting on June 13, 2011 at 6:00pm

Highway Department:
• Ed sent new maps to Delta Engineers so they can pick new roads to place counters.
• Single Stream Recycling will be in effect. Meaning all recyclables can now be placed in the same container and plastics, glass and cans do not have to be separated starting July 4, 2011

Question and comments from the public present:
Andy Minnig asked what the date of the Public Hearing will be for the Draft Local Land Use Law? The Public Hearing will be June 16 @ 7:00PM.

Richard Page asked if the Board will be voting on the Final Land Use Law. He feels the Board will be making a big mistake if they pass this law. Mr. Page also stated he felt like the token farmer on the Land Use Committee. He felt a lack of respect.

Matt Utter feels the plan is premature. There is no agriculture assessment. The Board will not be doing Justice for the Town. Gas and mineral rights have not been addressed. The Board has not come to the big land owners in Town and spoken to them to get their opinions. There is more wrong with the plan. Where was Nan Stolzenburg approved as the Town Planner?

Highway Department:
·        Ed will contact Delta Engineers to ask where they want to put the traffic counters.

 Resolution 2011-4 Environmental Assessment Form-Negative Declaration
Proposed Action:  Environmental Assessment Form-Negative Declaration
WHEREAS:  The Cherry Valley Town Board has carefully reviewed the Environmental Assessment form.  The Comprehensive Plan has been reviewed by the Town Board and we are fully familiar with the Plan as well as the proposed Town of Cherry Valley Land Use Law, and
WHEREAS:  Various maps of the Town were presented for the Comprehensive Plan and these were reviewed in relation to EAF, and
WHEREAS: The proposed Land Use Law incorporates protection of the current uses of the land in the Town and allows growth in a manner consistent with the historic and scenic nature of the community.  The community continues to be primarily agricultural; the proposed Local law encourages continuation of agricultural pursuits, and
WHEREAS: Growth of the Town along the nature currently existing appears it is not authorized but is encouraged by the proposed Local Law, therefore
IT IS RESOLVED:  That the Town Board determines that there are no impacts that would negatively effect the environment of the Town of Cherry Valley in the proposed Local Law, and
BE IT FURTHER RESOVED:  That the Town Board has determined that a negative declaration is
appropriate, and
BE IT FURTHER RESOLVED:  To authorize the Town Supervisor to sign the Full Environmental Assessment Form indicating same and see to the appropriate filing and publishing.
 Councilperson Chris Barown made a motion to adopt Resolution 2011-4 Environmental Assessment Form-Negative Declaration, Seconded by Councilperson Horvath.  Roll call vote is taken: Supervisor Garretson-yes, Councilperson Barown-yes, Councilperson Horvath-yes, Councilperson Johnson-yes, and Councilperson Cornwell-excused. 4 yes 0 no.

Councilperson Barown made a motion to send a copy of the Land Use Law, Referral Sheet, Negative Declaration, Environmental Assessment Form and any other necessary documents required to the County Planning Board, Councilperson Horvath seconded the motion.  Motion carried.

Tavis Austin presented information pertaining to a Circuit Rider Planner for little or no cost for a Town Planner for the Town of Cherry Valley.  Mr. Austin would be interested in being employed as a liaison between the County and the Town.  Grant writing can also be offered.  Mr. Austin would also be able to find answers and legal advice from the Association of Towns. 

 Mr. Green, Town Attorney, strongly suggests the Town consider hiring such and individual.  He feels this would be an invaluable service to the Planning Board, who will be administering the Land Use Document.

Paul Mendelsohn thanked the Board for all their hard work and he likes what the OCCA & Tavis are offering.
