The regular meeting of the Town Board of Cherry Valley was held on Thursday, June 08, 2017 with meeting called to order at 7:01PM by Supervisor Garretson.

Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Waterfield seconded the motion. The invoices and payments have been presented and accepted. All in favor 4 yes 0 no. Motion carried.

Presentation of Invoices and Payments:
• Budget reviewed as well as NBT Account balances.

Misc. information to the Town Clerk:
• Sales tax for the month of APR $5,097.13
• Audit being done with the Assessor

Health Center:
• Department of Health states there was a law passed in 1978 that the two health care providers had to be employees of the Town. Then in 2014 the law was amended to state only 1 health care provider needed to be an employee of the Town. In 2017 DOH said a work around would be to pay the Town Health Officer of the Town. Motion made by Councilperson Cornwell to pay Maureen Kuhn current Health Officer of the Town $200 a year seconded by Councilperson Johnson all in favor 4 yes 0 no. Motion carried.

Community Center/Alden Fields and Park:
• Cherry Valley Woodsman Day June 16-18
• Cherry Valley/Cherry Valley-Springfield Alumni Association Banquet July 8
• Auditor asking if the Contract for the Community Center states the Community Center and or Town is released of any liability to the renter. The contract does.
• Stihl should supply a certificate of insurance for the event they are sponsoring. Councilperson Waterfield will look into this request.
• ABM coming to inspect fire extinguishers at the Community Center
• Carpet was cleaned in the conference room.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Supervisor Garretson received a call from the Village Clerk concerning the little cemetery between Lanes farm and __________ regarding the stones? Inquiry as to who owns the cemetery. The Town owns any cemetery abandoned by families within the Town boundaries.

Town Planning:
• Supervisor Garretson was contacted by Iver Lindberg regarding purchasing the land behind the Town parking lot. Discussion took place regarding the land being wet lands.

Highway Department:
• Motion made by Councilperson Waterfield to create an office of Deputy Superintendent of Highways Seconded by Councilperson Johnson. All in favor 4 yes 0 no Motion carried.

Federal/State/County:
• Supervisor Garretson received a letter from Karen Sullivan at the County regarding the dumpsters. Again people are dumping items that are not supposed to be left or put into the recycling dumpsters. The Town will incur fines if this continues.
• Dave Bliss, County Rep is present at tonight’s meeting and gave the Board an update of County business.

Resolution 2017-4 Senior Citizen Tax Exemption was reviewed and needs to be reworded so this resolution has been tabled for now.

Resolution 2017-5 Audit of Town Justice Court Records.

PROPOSED: Required annual examination and audit of town justice court records and dockets

WHEREAS: Section 2019-a of the Uniform Justice Court Act requires that town justices annually provide their court records and dockets to their respective town auditing board, and that such records then be examined or audited and that fact be entered into the minutes of the board’s proceedings; and

WHEREAS: The town supervisor on behalf of the town justices ha presented the court records and dockets to the town board for examination and audit; and

WHEREAS: Record of this examination, audit and resolution will be forwarded to Joan Casazza, Internal Control Liaison, NYS Office of Court Administration, 2500 Pond View, Suite LL01, Castleton-on-Hudson, NY 12033; and

NOW, THEREFORE BE IT RESOLVED: The town board has conducted the required
examination and audit of the court records and dockets of the Town of Cherry Valley for the calendar year 2016

Motion made by Councilperson Cornwell to adopt the Town Justice Court Records as presented, seconded by Councilperson Waterfield. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Cornwell-yes, Councilperson Johnson-yes, and Councilperson Waterfield-yes. 4 yes 0 no. Duly carried.

Question and comments by the public present:
Mr. Minnig asked what Ed’s role will be at the highway if he is the Deputy Superintendent of Highway’s? Clarification was given to Mr. Minnig by the board of Ed’s impending retirement and the appointment of a Deputy Highway Superintendent.
