The regular meeting of the Town Board of Cherry Valley was held on Thursday, July 14, 2011 with meeting called to order at 7:15PM by Supervisor Garretson.

Pledge to the Flag was said.
Roll call of Officers was taken:

Minutes of the June 2011 meeting were read. Supervisor Garretson approved as read.

Councilperson Barown made a motion to accept the invoices and payments as read Councilperson Horvath seconded the motion. The invoices and payments have been presented and accepted. All in favor 5 yes 0 no. Motion carried.

Presentation of Invoices and Payments:
• Budget reviewed with Board
• NBT Account Balances reviewed by Board

Information presented to the Town Clerk by Supervisor Garretson is as follows:
• Town share of monthly County sales tax collected for the month of April 2011 is $4,722.01.
• Three checks from the Treasurer of Otsego County
1. Fringe Benefits 10/2010-4/2011 $2,821.48-Snow & Ice
2. Snow & Ice Jan-Apr 2011 $47,406.17
3. Mortgage Tax 10/1/10-3/31/11 $2,715.22

Community Center/Alden Fields and Park:
• There will be a Community Softball Game Day on August 27 as a fund raiser for the Community Center.
• Opera will be rapping up their rehearsals by mid July

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Visitor’s Center:
• Construction Management and Contract Document are tentative. Supervisor Garretson reported the State Bids are handled differently and will be going out in approximately 3 weeks.

Town Planning:
• NYS Real Property Tax Service notice of equalization rate = %100
• NYS 2% Property Tax Cap-Town Budget Review will be at the August meeting. If the Town maintains the 100% equalization rate we will get back $5 per parcel.

Highway Department:
• Delta Road Preservation Program. Joint SEQR process with the County. Supervisor Garretson would like Councilperson Cornwell to work on the Road Preservation Program.
• Free Rabies vaccination Clinic is September 6 from 6-8PM at the Town Barn, Main Street.

Federal/State/County
• The Land Use Document was presented to the County Planning Board, which gave their approval to adopt the CV Land Use Law, before they disbanded.

Resolution 2011-5 Amendment to NYSDOT Snow and Ice Contract was read. Motion to adopt Resolution 2011-5 Amendment to NYSDOT Snow and Ice Contract was made by Councilperson Cornwell and seconded by Councilperson Johnson. Roll Call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes, and Councilperson Horvath-yes. 5 yes 0 no. Duly carried. Resolution 2011-5 NYSDOT Snow and Ice Contract will be filed at the Town Clerk’s office.

Local Law 2011-3 Town of Cherry Valley Land Use Law was read. Motion to enact as presented made by Councilperson Barown seconded by Councilperson Horvath. Roll call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no. Duly enacted. Local Law 2011-3 Town of Cherry Valley Land Use Law will be filed at the Town Clerk’s office.

Question and comments from the public present:

Dennis Laughlin wanted to thank the Highway Department for blacktopping Nielson Road.

Karina Gable asked how the Board would handle some one with land who wanted to pursue a Business in their home. Walter Buist Planning Board Chairman commented these would have to be looked at individually.

Supervisor Garretson recommends the Comprehensive Plan adopted in 2007 be reviewed every 5 years.

Kathleen Taylor thanked the Board for protecting the Town with this Law.

There being no further business a motion is made by Councilperson Cornwell to adjourn the meeting, seconded by Councilperson Horvath meeting adjourned at 7:51PM.
