PUBLIC HEARING FOR NEW DOG CONTROL LAW is opened at 7:00pm, February 10, 2011. There was no discussion held by the public present. Public hearing closed at 7:01pm.

The regular meeting of the Town Board of Cherry Valley was held on Thursday, February 10, 2011 with meeting called to order at 7:01PM by Supervisor Garretson.

Councilperson Barown made a motion to accept the invoices and payments as read Councilperson Cornwell seconded the motion. The invoices and payments have been presented and accepted. All in favor 5 yes 0 no. Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
Town share of monthly County sales tax collected for the month of Nov 2010 is $7,276.
Received thank you note from The Roseboom Area Senior Citizens group for the Town’s donation to the club.
Received a thank you note from Kathy Lane-Treasurer for the Museum for the Town’s donation to the museum.

Community Center:
· Revenue for January $0 and Expenses $3,890
· Girl Scouts will be painting the women’s bathroom
· Winter Carnival is being planned
· Opera will be renting space this summer
· Reservations are being made to rent the gym for private events.

Miscellaneous Information:
Two letters of interest have been received for the upcoming vacancy on the Town Board.
The letters received are from Linda Franzese and Jim Falvino
Sample of new signage for the Town’s entrances.
Cherry Valley Library appreciation day tentative for spring of 2011.

Health Center:
Revenue for January $23,414. Expenses $38,303.

Town Facilities:
Tentative for Spring 2011-Stone and Oil Area of Community Center Parking Lot

Village:

Visitor’s Center:
John Sagendorf-Director of the Route 20 Association is the new Cherry Valley Rep.
A public hearing was held for the Villages Comprehensive Plan. The Comprehensive Plan has been accepted.

Town Planning:
George Cade gave an update of the revaluation project. March 7 and March 14 scheduled for informal hearings. All exemptions must be filed by March 1, 2011. Farm exemptions must be filed by April 1, 2011
There will be a meeting with Delta Engineers on February 17, 2011 at the Oneonta County Building. Councilperson Cornwell asked if whoever was going to be present to ask Delta about the Local Law that was promised and paid for exists and can the Town have a copy of the Law.
Land Use document still in its final stages after Nan Stoltenberg’s recommendations have been considered and applied where applicable. Councilperson Barown also mentioned having a Zoning Board of appeals which would be 3 or 5 people. An enforcement officer needs to be in place, some Towns use their Assessors for this purpose or the County Enforcement Officer is also a choice.
Walter Buist spoke with Terry Bliss, Otsego County Planner, regarding the proposed Verizon Tower for Route 20. At a Public Hearing there was a request to move the Tower 100feet to the East. The County is awaiting revised plan for approval. Walter also presented a lengthy overview of the proposed gas drilling issues and conversations he has had with Terry Bliss regarding Laws for Mineral extractions.


Highway Department:
NYS Mined Land Survey and Permit are still in progress.
Still in the process of finding a pickup truck for the Town

Local Law 2011-1 Dog Control Law of the Town of Cherry Valley is voted on: Motion made by Councilperson Cornwell to adopt Local Law 2011-1 Dog Control Law of the Town of Cherry Valley, motion seconded by Councilperson Horvath. Roll Call vote is taken: Supervisor Garretson-yes, Councilperson Barown-yes, Councilperson Johnson-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no Motion duly carried.

Local Law 2011-1 Dog Control Law of the Town of Cherry Valley can be viewed on the Town Website or in the Town Clerk’s office during regular business hours or by contacting the Town Clerk to schedule an appointment.

Questions and comments were entertained by the public present.
Paul Mendelsohn recognizes the Town taking on the Local Law for Land Use document and appreciates the time and effort being put into the Law. Mr. Mendelsohn also inquires about the possibility of the Town being sued down the road with conjunction to the Gas Drilling Issue.

Andy Minnig inquired about having a legal defense fund set up.

George Cade made the comment that there is gas drilling going on in other areas of the State.

Motion made by Councilperson Barown to adjourn the meeting, seconded by Supervisor Garretson meeting adjourned at 8:30PM.
