The regular meeting of the Town Board of Cherry Valley was held on Thursday, July 09, 2009 with meeting called to order at 7:00PM by Supervisor Garretson.

Pledge to the Flag was said.

Minutes of the June 2009 meeting were read. Supervisor Garretson approved the minutes as read.

Councilperson Cornwell made a motion to accept the invoices and payments as read Councilperson Johnson seconded the motion. The invoices and payments have been presented and accepted. All in favor 3 yes 0 no. Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
Town share of monthly County sales tax collected for the month of April 2009 is $4,139.00.
Community Center:
Revenue for June $192.00. Expense $1,545.
Supervisor Garretson would like Mary Beth to contact the Village Clerk and inquire if the Village has a line for the Community Center in their annual budget. Questioning the soda invoice and the revenue.

Miscellaneous Information:
Supervisor Garretson received a thank you note from Claudine Haig for the donation from the Town for the Silver and Gold seniors.
Supervisor Garretson read an excerpt from Field, Forest and Fen in regards to the Thayer Homestead being part of an Archaeological study at CVSCS and SUNY Oneonta under the direction of Social Studies instructor, Melissa Jaquay.

Health Center: July Revenue $31,591. Expenses $29,141.

Town Facilities:
Supervisor Garretson met w/ Bill and Jeff regarding the ongoing construction and general maintenance of the Community Center meeting room. Water fountain needs to be repaired as well as a broken window in the gym. Thompson Electric will be finishing the light switches and outlets. Handicap ramp needs to be installed at the new doorway entrance and will match the current ramp in the back of the building. Need to get price quotes from Crazy Tom’s for carpeting. Three round tables and chairs have been donated by Fox Hospital to the Community Center.

Village:
Town and Village board minutes and info are online at cherryvalleyny.us
American Legion 5K/ Run/Walk-Veteran’s Day Weekend, November 07, 2009. Registration forms are available outside the Town Clerk’s office on the bulletin board and at Larry’s Barber Shop.

Visitor’s Center:
Lynn Green, Town Attorney, reviewed the lease agreement and has outlined some concerns and recommendations. The current lease is being revised.
Supervisor Garretson stated in order to keep the Grant Money the Town needs to apply and invoice towards the project. He sent an invoice for current expenses for Foyt-Albert to Barb Thomas. This invoice reflects charges for postage.
Supervisor Garretson also noted the Visitor Center Project is listed in the Mohawk Valley Economic Development District.

Planning Board:
Supervisor Garretson called and left a message for Walter to return his call.

Highway Department:
Rabies Clinic is scheduled for September 15th from 6-8PM @ the Town Barn.

Alternative/Renewable Energy Committee:
Update on East Hill Wind mapping and comparable NYS setbacks.

Resolution # 2009-5 July 09, 2009

Resolution of the Cherry Valley Town Board

Proposed Action: Amendment to change the Snow and Ice Agreement signed on November 8th 2007

WHEREAS, due to the severity of the winter and the high cost of fuel during the 2008/2009 season, this municipality request that the Municipal Snow and Ice Agreement estimated expenditure be revised to reflect the additional lane miles of sate roads that were plowed and or treated during the afore mentioned season, and the additional costs associated with the higher fuel prices, and

WHEREAS, all terms and conditions of the original cataract extension remain in effect except the original estimated expenditure of $47,690.39 will have an additional adjustment of $16,716.85 for a revised estimated expenditure of $64,407.23; and

NOW THEREFORE, BE IT RESOLVED, this board authorizes Thomas Garretson-Supervisor to enter into amendment B which will adjust the 2008/2009 snow and ice contract for a revised payment factor with the New York State Department of Transportation.

Motion made by Councilperson Cornwell to adopt Resolution #2009-5, seconded by Councilperson Johnson. Roll call of votes is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, and Councilperson Cornwell-yes. All in favor 3 yes 0 no. Resolution 2008-5 is duly carried.

Questions and comments were entertained by the public present.

Andy Minnig had a question regarding the bills for the Community Center and who donated the furniture to the Community Center? Also what was the name of the teacher offering the Archeology study at CVSCS?

Paul Mendohlson stated he attended the Morrisville conference regarding gas drilling. He gave a brief presentation of what he learned at this conference. Suggestions such as revisit Highway Road Laws, Real Property tax laws etc.

Motion made by Councilperson Cornwell to adjourn the meeting, seconded by Councilperson Johnson meeting adjourned at 7:54PM.
