Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Barown seconded the motion.  The invoices and payments have been presented and accepted.  All in favor 4 yes 0 no.  Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
  • Town share of monthly County sales tax collected for the month of February 2011is $6,405.73
  • Thank you note from the Cherry Valley Memorial Library Board
  • Budget review conducted by the Board
  • NBT Account Balance reviewed by the Board
  • Memorandum from the County Office Building Planning Department entitled Recycling Attendants
Community Center/Alden Field and Park:

  • Cherry Valley Library appreciation dinner September 17, 2011
Village:
Town Planning:
  • George Cade reports Village residents got a reduction in their assessments after the State review.
  • Still no word from Delta Engineers regarding the Road Use Law
  • Minutes presented by Supervisor Garretson for the Special Meeting of the Cherry Valley Town Board on April 21, 2011 taken by Councilperson Cornwell in the absence of the Town Clerk Flint.  Motion to accept the minutes as presented is made by Councilperson Barown seconded by Councilperson Horvath.
Highway Department:
·        Ed will contact Delta Engineers to ask where they want to put the traffic counters.

 Resolution 2011-4 Environmental Assessment Form-Negative Declaration
Proposed Action:  Environmental Assessment Form-Negative Declaration
WHEREAS:  The Cherry Valley Town Board has carefully reviewed the Environmental Assessment form.  The Comprehensive Plan has been reviewed by the Town Board and we are fully familiar with the Plan as well as the proposed Town of Cherry Valley Land Use Law, and
WHEREAS:  Various maps of the Town were presented for the Comprehensive Plan and these were reviewed in relation to EAF, and
WHEREAS: The proposed Land Use Law incorporates protection of the current uses of the land in the Town and allows growth in a manner consistent with the historic and scenic nature of the community.  The community continues to be primarily agricultural; the proposed Local law encourages continuation of agricultural pursuits, and
WHEREAS: Growth of the Town along the nature currently existing appears it is not authorized but is encouraged by the proposed Local Law, therefore
IT IS RESOLVED:  That the Town Board determines that there are no impacts that would negatively effect the environment of the Town of Cherry Valley in the proposed Local Law, and
BE IT FURTHER RESOVED:  That the Town Board has determined that a negative declaration is
appropriate, and
BE IT FURTHER RESOLVED:  To authorize the Town Supervisor to sign the Full Environmental Assessment Form indicating same and see to the appropriate filing and publishing.
 Councilperson Chris Barown made a motion to adopt Resolution 2011-4 Environmental Assessment Form-Negative Declaration, Seconded by Councilperson Horvath.  Roll call vote is taken: Supervisor Garretson-yes, Councilperson Barown-yes, Councilperson Horvath-yes, Councilperson Johnson-yes, and Councilperson Cornwell-excused. 4 yes 0 no.

Councilperson Barown made a motion to send a copy of the Land Use Law, Referral Sheet, Negative Declaration, Environmental Assessment Form and any other necessary documents required to the County Planning Board, Councilperson Horvath seconded the motion.  Motion carried.

Tavis Austin presented information pertaining to a Circuit Rider Planner for little or no cost for a Town Planner for the Town of Cherry Valley.  Mr. Austin would be interested in being employed as a liaison between the County and the Town.  Grant writing can also be offered.  Mr. Austin would also be able to find answers and legal advice from the Association of Towns. 

 Mr. Green, Town Attorney, strongly suggests the Town consider hiring such and individual.  He feels this would be an invaluable service to the Planning Board, who will be administering the Land Use Document.

 Public questions, comments and concerns:
Paul Mendelsohn thanked the Board for all their hard work and he likes what the OCCA & Tavis are offering.

 There being no further business a motion is made by Councilperson Barown to adjourn the meeting seconded by Councilperson Horvath.  Meeting adjourned at 8:20PM

Councilperson Barown made a motion to accept the invoices and payments as read Councilperson Horvath seconded the motion.  The invoices and payments have been presented and accepted.  All in favor 5 yes 0 no.  Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:

  • Town share of monthly County sales tax collected for the month of January 2011 is $3,824.
  • Check from Treasurer of Otsego County $21,110.26-Snow & Ice Oct-Dec 2010
  • Check from Otsego Auto Crushers $1,212.60 for old Town pick up truck.
  • Dog Report from DCO-Jaird Johnson for the months of Dec-2010 to Mar 2011
  • News paper advertisements from The Daily Star and the Cooperstown Crier
  • Letter of interest for the upcoming Town Board vacancy from Tracy A. Donovan
Community Center/Alden Fields and Park: 

  • Revenue for March was $535 and Expenses for March were $3,834.
  • Winter schedule is wrapping up.  The Opera will be renting the Community Center through June and July sporadically.
  • Other rentals continue to be booked
  • Mary Beth stated the Expense and Revenue report for the Community Center as reported each month looks skewed because of the vast difference.  Supervisor Garretson reported the numbers are on target according to the Community Center Budget.  Utilities are bundled to create one check in regards to the Community Center, Health Center and other building maintenance expenses.
Health Center: 

  • Revenue for March $43,503 and Expenses for March was $32,985
Town Facilities:

  • Stone and Oil area of Community Center Parking Lot-tentative.
 Village:

  • Town and Village board minutes online @ cherryvalleyny.us
Visitor’s Center: 

  • Septic design approved by Otsego County Code Enforcement Office
Town Planning:

  • George Cade reported he is finished with the revaluations and will be meeting with the Board of Review.  Tentative Tax Roll will be printed by May 1, 2011.
  • Lynn Green, Town Attorney, recommended a training session or two with the Board of Review.  The BOR should have some familiarity of how the revaluations process works before grievance day on May 24, 2011
  • Tavis Austin from Otsego County Conservation Program gave an update regarding the Road Agreement with Delta.  Tavis has inquired numerous times for an update from the office of Terry Bliss, County Planning Board, but to no avail.  There is a new Road Use Tab on the County Website.  The Law template is not available from Delta as of this date.
  • Land Use Committee adopted a resolution to forward the Draft Land Use Law along with letters of comment to the Town Board.  Currently Supervisor Garretson is in possession of these items.  Lynn Green, Town Attorney, recommended taking time to review the document thoroughly since the DEC will not be ready until September to move forward.   Haste makes waste.
Highway Department: 

  • Mining permit and survey have been mailed out.
  • Replacement pick up truck has been purchased it is a 1999 Ford F150
Federal/State/County:

  • Jerry Mirello is the new contact with the State for the Snow & Ice removal in the Village, also know as Main Street.
Resolution 2011-3 NYS Disability Insurance Coverage

Proposed Action:  New York State Disability Insurance Benefits Coverage to Full Time Town Employees

 Whereas, The First Rehabilitation Life Insurance company of America is the new provider of the Town’s Disability Insurance coverage to the Town’s full time employees, and

Whereas, By New York State Law the Town is required to adopt a resolution stating that the Town will provide Disability Insurance coverage to the Town’s full time employees, and

Now, therefore be it resolved, The Town of Cherry Valley will provide annual Disability Insurance coverage of the full time employees of the Town of Cherry valley.

Motion made by Councilperson Johnson to adopt Resolution 2011-3 NYS Disability Insurance Coverage, seconded by Councilperson Cornwell.  Roll call vote is taken:  Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes, and Councilperson Horvath-yes.  5-yes 0-no duly carried.

Question and comments from the public present:

Andy Minnig inquired about a timeline for the Draft Land Use Document

Town Attorney Lynn Green stated the Draft Land Use Document will be completed in a timely manner.

 Tavis Austin presented a data sheet as information only to the Town Board as a comment/submission during the Public Comment on future land use law amendments.

 The Town Board will be having a work session on April 21 at 7:00 to review environmental assessment review form.

Motion made by Councilperson Barown to adjourn the meeting, seconded by Councilperson Horvath meeting adjourned at 8:10PM.
