Dennis Laughlin inquired about Health Center revenue and how did it jump so much? Councilperson Barown answered with there was a delay in compensation for services provided by Medicaid and Medicare. Noticed Mortgage tax was lower than anticipated due to slow economy in terms of real estate sales within the Town. It is difficulty for individuals to get financing to purchase land.

Motion made by Councilperson Barown to close the public hearing and seconded by Councilperson Cornwell. All in favor 4 yes 0 no.

Misc. information to the Town Clerk:
• Sales tax for the month of Sept $9,421.39
• Dog reports going back to May and up to November
• Supervisor Garretson presented information Councilperson Cornwell to apply for a grant for trees for Arbor Day.

Community Center/Alden Fields and Park:
• WIC is not moving from the Community Center as the need for mandatory internet access is delayed until 2019 by the State. However they are using a jetpack through Verizon to have access to the internet as needed.
• Biddy Basketball has begun.
• Thanksgiving Eve Dance will be November 26
• Need to have the Carpet Doctor clean the Board room carpet.
• Would like to replace the heavy tables with the lighter white tables each year as the budget allows along with chairs
• Legion held their Run/Walk and it went very well.
• Community Center Board will be meeting next week to discuss a work detail and other issues as needed.

Misc. Updates:
• Councilperson Barown has been asked to sit on the Food Pantry Board to see this service continue for people in the surrounding area.

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Highway:
• HS VanDerWeker needs to do some blasting @ the quarry and Spectra Environmental Group will be modifying the current mining permit to have a baseline which includes surveying the quarry this will cost $8,500. Motion to have Spectra revise current Minor permit is made by Councilperson Barown and seconded by Councilperson Cornwell. All in favor 4 yes 0no. Motion carried.

Federal/State/County:
• Workman’s comp expense is being handed over to the Town’s. For the Town of Cherry Valley it is going to be an extra $12,000 a year. Need to budget this for 2016
• The only change in the Budget is the Town did not have the Fire Department’s budget and now we do so that is the change in the Preliminary Budget.

Town of Cherry Valley 2015 Preliminary Budget adoption. Motion to adopt the budget as presented is made by Councilperson Cornwell and seconded by Councilperson Barown. All in favor 4 yes 0 no. 2015 Budget has been adopted.

Resolution 2014-11 NYS DOT Local Roads Listing Update/Correction

Proposed action: Review and update/correction to the New York State Department of Transportation Local Road Listing as requested.

Whereas: The Town of Cherry Valley listing has been reviewed and updated where necessary.

Mr. and Mrs. Thomas Spencer asked that Morton Road be kept open all year as they need to get their wood supply to customers.

Mrs. Spencer also inquired about the Food Pantry’s hours and will there be a notice somewhere so people will know when the Food Pantry can be accessed.

Local Law 2014-1 of the year 2014 Town of Cherry Valley, Count of Otsego
Tax Levy Limit Override

A local law to override the tax levy limit established in General Municipal Law 3-c
Section 1. Legislative Intent
It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Cherry Valley, County of Otsego pursuant to General Municipal law 3-c, and to allow the Town of Cherry Valley, County of Otsego to adopt a town budget for (a) town purposes (b) fire protection districts and (c) any other special or improvement district governed by the town board for the fiscal year 2015 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law 3-c

Section 2. Authority
This local law is adopted pursuant to subdivision 5 of General Municipal Law 3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by vote of sixty percent (60%) of the town board.

Section 3. Tax Levy Limit Override
The Town Board of the Town of Cherry Valley, County of Otsego is hereby authorized to adopt a budget for the fiscal year 2015 that requires a real property tax levy in excess of the limit specified in General Municipal Law 3-c.

Section 4. Severability
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional such order or judgment shall not affect, impair, or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, firm or corporation, or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5. Effective date
This local law shall take effect immediately upon filing with the Secretary of State.

Local Law 2014-1 Tax Levy Limit Override is reviewed by the Town Board

Preliminary Budget is being proposed to the Town Board. Extra copies are available in the Town Clerk’s office.

Resolution 2014-8 Audit of Town Justice Court Records and Dockets. Motion to adopt Resolution 2014-8 is made by Councilperson Cornwell seconded by Councilperson Barown. Roll call vote is taken Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes 4 yes 0 no Resolution 2014-8 is duly carried.

Resolution 2014-9 NYS snow and Ice Contract Extension 2014/2015
Proposed Action: Snow and Ice Contract Extension 2014-2015-between NYSDOT and the Town of Cherry Valley

Whereas, the NYSDOT and the Town of Cherry Valley have entered into agreement # D010680 entitled “Indexed Lump Sum Snow and Ice Agreement between the New York State Department of Transportation and the Town of Cherry Valley dated January 14th 1997, and

Whereas, the present term of the agreement as previously extended, expires June 30th 2014, and

Whereas, the said agreement provides for an annual update of the estimated expenditure to be determined by NYSDOT, and

Now, therefore be it resolved: The aforementioned agreement between the NYSDOT and the Town of Cherry Valley is hereby extended for a period of one year; now to expire on June 30th 2015, and

Further be it resolved: The estimated expenditure of the agreement shall be $5,105.39 per lane mile of 12.6 lane miles for a total of $64,327.87 for the 2012/2013 season and for the remainder of the term of the agreement, unless changed by a future update.

Keith Schue a local resident who works with Otsego 2000 presented information to the Town Board on the Dominion Pipeline Project and how their project implicates Otsego County.

Tammy Saba came to discuss the potential dog problem in the Village and is concerned with the public safety issue at large.

Presentation of Invoices and Payments:
• Budget reviewed as well as NBT Account balances.
• Councilperson Barown inquired if the Town had a surplus does that surplus go into a reserve? Superintendent Garretson stated the Town can’t carry over more than the budget. There is a limit to what Town’s can carry over. Councilperson stated he thinks there is a limit that can go into reserves and the remainder has to go towards next year’s budget. The Town has never had this problem he was just inquiring.
• Supervisor stated NYS is changing the way the CHIPS money is dispersed to Towns for the end of the year. Currently the Town has paid December Highway invoices in January when the tax money comes in January. The State is holding back on sending the CHIPS money until all the invoices are paid for the year. Once the State receives the cancelled checks from the Town, then the CHIPS money is released. Supervisor Garretson will contact the bank and see about taking out a short term loan for a revenue anticipation loan to pay the invoices for the end of the year. Town Attorney Green will need to prepare the paperwork for the lending institute. Town Attorney Green stated the Town needs to get 3 different quotes form lenders to compare interest rates. The Town has a best value policy not necessarily lowest bid policy. A motion is made by Councilperson Barown for the Town Supervisor to take out a revenue anticipation note to cover the end of the year invoices, motion seconded by Councilperson Cornwell. Roll call vote is taken: Supervisor Garretson=yes, Councilperson Johnson-yes, Councilperson Cornwell=yes, Councilperson Barown=yes 4=yes and 0=No

Councilperson Barown has been trying to contact the Cornerstone rep he has dealt with to speak to him about the Town phone bills and the rep has not gotten back to him.

The tentative Budget is presented to the Board tonight. The preliminary budget will be presented to the Board at the October Town Board meeting.

There will be a public hearing for Local Law 2014-1 Tax levy limit override if needed.

Miscellaneous Information presented to the Town Clerk by Supervisor Garretson is as follows:
• Town share of monthly County sales tax collected for the month of June 2014 is $8,791.43
• Treasurer of Otsego County fringe benefit for snow and ice $2,942.82

• Tentative budget will be presented at the next Town Board meeting.
• Local community members as well as past community members looking into doing the reenactment of the CV Massacre as an annual or biannual event.

Community Center/Alden Fields and Park:
• Fall activities are beginning so the center will be increasing in activity. Fall soccer is also beginning

Health Center:
• Councilperson Barown has been researching companies to audit how the Health Center is collecting insurance reimbursement. Such as are we billing correctly, coding services correctly, etc.

Highway Department:
• Mill road bridge railings are fixed. Abutments are next. Shale pit on East Hill needs to have a permit for blasting. Superintendent VanDerWerker is working on the permit. Superintendent presented prices for a new truck.

Resolution 2014-6 Amendment to NYS Snow and Ice Contract
Resolution 2014-6 of the Cherry Valley Town Board

PROPOSED ACTION: Amendment to Contract #D01680 of the Municipal Snow and Ice

WHEREAS: due to the severity of the winter and the high cost of fuel during the 2013-2014 season the municipality request that the Municipal Snow and Ice Agreement estimated expenditure be revised to reflect the additional lane miles of state roads that were plowed and or treated during the aforementioned season, and the additional costs associated with the higher fuel prices, and

WHEREAS: all terms and conditions of the original contract extension remain in effect except the original estimated expenditure of $61,165.65 will have an additional adjustment of $21,591.47 for a revised estimated expenditure of $82,757.12, and

NOW, THEREFORE, BE IT RESOLVED: this board authorizes Thomas Garretson-Supervisor to enter into amendment B which will adjust the 2013/2014 snow and ice contract for a revised payment factor with the New York State Department of Transportation.

Motion to accept Resolution 2014-5 Speed Reduction on a portion of County Highway 54 made by Councilperson Cornwell and seconded by Councilperson Barown. Andy Minnig was inquiring about how much funding the Town would be putting towards an annual or biannual reenactment of the Massacre.

Community Center/Alden Fields and Park:
• Continues to be rented and utilized. Mathias VanDerWerker presented Mary Beth with quotes from two different vendors for a floor machine. The gym floor is in need of some attention in regards to cleaning and preserving the present gym floor. Mary Beth will be scheduling a meeting with the Community Center Board of Directors in the near future to get their input on the floor machine purchase.

Highway Department:
• Start working on the Bridge. Highway Superintendent VanDerWerker has submitted the paperwork to FEMA for the project and is waiting for FEMA’s response.

Community Facilities Corp/Old School
• Little Lambs is officially out of the space.

Village:

• Beth Rosenthal, County Rep presented the County update.
Resolution 2014-5 Speed Reduction on a portion of County Highway 54.
Resolution 2014-5 of the Cherry Valley Town Board

PROPOSED ACTION: Request by the Town of Cherry Valley for a New York State speed reduction on a portion of County Highway 54

WHEREAS: 3 accidents have been recorded and documented by failing to negotiate the curves, turns and the blind hill on the proposed portion of County Highway 54; and

WHEREAS: There is no advantage to accelerate and then proceed to decelerate within the 0.6 mile of the 55 MPH zone; and

WHEREAS: The safety of the drivers and residents of County Highway 54 are of the ut most importance to the Town of Cherry Valley; and

NOW, THEREFORE, BE IT RESOLVED: The Cherry Valley Town Board requests that the New York State speed limit be reduced from 55 MPH to 45 MPH on County Highway 54, from the Village of Cherry Valley to the Cherry Valley-Springfield Central School.

Motion to accept Resolution 2014-5 Speed Reduction on a portion of County Highway 54 made by Councilperson Barown and seconded by Councilperson Johnson. Roll call vote is taken Supervisor Garretson-yes, Councilperson Barown-yes, Councilperson Johnson-yes, Councilperson Cornwell-yes 4 yes 0 no. Resolution 2014-5 duly carried.

• Councilperson Barown stated the Daycare is definitely closing.
• Town Clerk Office rent needs to be paid.
• The space is available for rent.

• Supervisor Garretson received another request for speed limit reduction for a portion of County Route 54. The request was received from Victoria Pressly via the Superintendent of Highways for the County, Ron Tiderencel.

• Status Quo weekends are filling up. Councilperson Barown spoke with Jeff Stiles regarding the storm windows for the Community Center and Jeff stated this definitely on the project agenda.

Town Facilities:
• Transfer Station continues to run smoothly.

Highway Department:
• Highway Superintendent VanDerWerker stated the new lights have been installed in the shop.

Community Facilities Corp/Old School
• Councilperson Barown stated the FC in talks with Little Lambs regarding their tenancy. The dormitory lease ends in August.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Mayor Flint reported the Village Board is trying to get a handle on the feral cat problem in the Village.
• Would like to do a work detail down at the entrance to the Park to install a bridge over the creek and replace the tube. So far he has gotten all the materials donated.
• The Mayor would also like to pave the streets of the Village but the numbers are too large for the Village to afford right now.
• Larry Thompson is doing a great job as the Cemetery caretaker.

Federal/State/County:
• Supervisor Garretson received a letter back from the State regarding the Speed reduction request on County Road 32 and it is under review by the State.
• Beth Rosenthal County Rep is present and gives an update on the County Business.

Resolution 2014-3 Sexual and other Harassment Prevention Policy is distributed and reviewed by the Town Board. Motion to accept Resolution 2014-3 as presented is made by Councilperson Cornwell and Seconded by Councilperson Barown Roll call vote is taken: Supervisor Garretson-yes Councilperson Barown-yes Councilperson Cornwell-yes and Councilperson Johnson-yes 4 yea 0 no. Resolution 2014-3 is duly carried.

Resolution 2014-4 Workplace Violence Prevention Procedure Policy is distributed and reviewed by the Town Board. Motion to accept Resolution 2014-4 as presented is made
by Councilperson Cornwell and seconded by Councilperson Johnson. Roll call vote is taken: Supervisor Garretson-yes Councilperson Barown-yes Councilperson Cornwell-yes and Councilperson Johnson-yes 4 yea 0 no. Resolution 2014-4 is duly carried.

Supervisor Garretson received a phone call last night from the Cherry Valley Alumni Association requesting a separate storage room at the Community Center for the memorabilia they receive from past alumnus. This request will be brought before the Community Center Board for consideration.

• Transfer Station is functioning better with On Time Waste being there.
• National Grid will be replacing all the lights at the Town Garage after the audit was completed.

Community Facilities Corp/Old School
• Chris reported they insulated ¾ of the pipes in the basement. The second story windows being replaced/restored and the ply board are slowly disappearing.
• The 10 year commitment with the daycare is up, which is what the Corp had to have in the building when they received the grant money to renovate. The lease will be up with Little Lambs. Discussions are being held how to charge Little Lambs Rent.

Village:

Town Planning:
• Supervisor Garretson received another phone call from the lady that wants to buy the parking lot for a Dollar General Store. For sale of property owned by the Town within the Village needs to have a Public Referendum. Will Green, Town Attorney affirmed this is what needs to happen if the Town decides to move forward with the sale of the parking lot.
• Risk management procedures are handed out to the Board. Every year the Town Insurance Co. asks if we have these policies in place.

Federal/State/County:
• Beth Rosenthal County Rep is present and gives an update on the County Business.

Resolution 2014-2 Speed Reduction Request on County Highway 32
PROPOSED ACTION: Request by the Town of Cherry Valley for a New York State speed reduction on a portion of County Highway 32

WHEREAS: 14 accidents have been recorded and documented by failing to negotiate the curves and turns of the proposed portion of County Highway 32; and

WHEREAS: The safety of the drivers and residents of County Highway 32 are of the up most importance to the Town of Cherry Valley; and

NOW, THEREFORE, BE IT RESOLVED: The Cherry Valley Town Board requests that the New York State speed limit be reduced to 45 MPH on County Highway 32, from US Route 20 north to Shulgay Road.

Councilperson Johnson made a motion to accept Resolution 2014-2 Councilperson Laughlin seconded the motion. Roll call vote is taken Supervisor Garretson-yes Councilperson Johnson-yes, Councilperson Barown-yes, and Councilperson Cornwell- yes Councilperson Laughlin-yes 5 yes 0 no.

Resolution 2014-2 is duly carried.

Supervisor Garretson has received a resignation letter from Councilperson Laughlin. She has accepted a new position that does not allow her to hold a political office. Councilperson Laughlin’s resignation is affective at the close of tonight’s meeting. It has been a pleasure serving with Councilperson Laughlin. The Town Clerk will notify the Board of Elections of the newly vacated seat on the Town Board.

• Chris brought up running Bingo, however this is a process that is restricted and a lot of leg work to get this up and running. So for now it is just an idea being considered.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Mayor Flint stated the Village has hired a new employee. Everything else is moving along as usual. Village elections are coming up as well.

Town Planning:
• Supervisor Garretson received an information update from Anne Marie Garti from FERC (Federal Energy Regulatory Commission). Because the Town signed on to be intervener’s we will receive updates periodically.
• National Grid came out and did an audit of the Town Highway Barn. Suggested replacing the lights. Estimated cost would be a little over $8,000 and National Grid would pay $4,500 of this upgrade.
• After this project the lights in the Gym should be looked at to be replaced some time.

Federal/State/County:
• Beth Rosenthal County Rep is present and gives an update on the County Business.

Question and comments by the public present:
Deri and Rosada Utter presented information regarding the many traffic accidents that have happened over the years near their home. Vehicles travel to fast through the curve. They are asking the Town if there is a way to apply to the State for a reduced speed limit through this section and at the very least put up some kind of chevrons indicating sharp curve.

Aaron VanBuren, Captain from the Cherry Valley Emergency Squad, presented a 911 reflective sign project they have been working on, to hopefully get everyone in the Town to have one of these 911 signs at their residence. The squad will be doing the installations for any resident who would agree to have a sign installed. The squad’s hope is to have the signs installed in the same or similar location at each residence so it will be easier to identify the residence when a call comes in instead of trying to find a sign that was maybe placed on a tree or a porch, etc. This would be optional to the resident and the squad would install the signs free of charge. Aaron has been looking into grants to pay for this project. He is here tonight to ask the Town for their consideration of helping out with the cost for this service.

Community Center/Alden Fields and Park:
• Biddy Basketball continues. Spaghetti dinner 2/22 to benefit CV children’s Christmas fund.

Town Facilities:
• Transfer station still continues to have TV’s left.
Community Facilities Corp/Old School
• Chris Barown reported William T Ryan Associates have submitted a bid to repair
• the front roof and gutter on the front of the building in regards to the gym area.
Health Center:
• Revenue has doubled from last year.

Town Planning:
• Supervisor Garretson touched on a letter he received from the County regarding the recyclable tonnage. The letter is pre-filled with numbers from the collector and the County is asking the Board to approve the numbers.

Question and comments by the public present:
• Scott Moxham from Ontime Waste addressed the board with his interest in managing the trash removal at the transfer station. He currently has the Village contract and is interested in improving the service currently at the Transfer station. Councilperson Barown did express there has been some inconsistency with the price for each kitchen bag of garbage. There has been a different individual “manning” the transfer station each weekend charging different prices per kitchen bag.
