The regular meeting of the Town Board of Cherry Valley was held on Thursday, October 8, 2009 with meeting called to order at 7:03PM by Supervisor Garretson.

Councilperson Cornwell made a motion to accept the invoices and payments as read Councilperson Johnson seconded the motion. The invoices and payments have been presented and accepted. All in favor 3 yes 0 no. Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
Dog Control Officers Report for April, May, June, July and August 2009.
Town share of monthly County sales tax collected for the month of July 2009 is $4,497.
Copies of monthly checks over $1,000 received will be presented to the Town Clerk

Community Center: Revenue for Sept $980.00. Expense $2,471.
Pork roast dinner at the Community Center Saturday, October 10 from 5-7

Miscellaneous Information:
Paycheck direct deposit is available. Monthly paychecks will be cut on the 25th of each month and mailed so recipients will have them by the 1st of each month.

Health Center:
Revenue for Sept $26,586. Expenses $34,912. Expenses are up due to Audit and employees receive 3 paychecks in the month of October.
Supervisor Garretson received a letter of request for resignation for a Health Center Board member.

Supervisor Garretson has requested a meeting with the Auditor to discuss the 2008 audit numbers. He has some concerns because the Supervisors numbers differ from the audit report by $90,000 in revenue.

Town Facilities:
William Ryan and Associates-new board room is ready for carpet. The room should be ready in time for Election Day voting on November 3.

Community Center Facilities Corp:
Supervisor Garretson suggested a meeting with himself, the Mayor of the Village and Mr. Dubben to discuss the financial numbers for the Facilities Corporation. The organization has been struggling to make ends meet as of late.

American Legion 5K Run/Walk Veteran’s Day Weekend-Nov. 7, 2009
2000 Chevrolet Dump Truck bids being accepted until October 19, 2009. So far no bids have been received.
Mathias VanDerWerker has been hired for the vacant position in the Village Department of Public Works

Visitor’s Center:
Survey completed and available for viewing
Foit-Albert rough draft of visitor center presented. Supervisor Garretson did not like some of the designs to the proposed Hop House draft blueprint. There will be a Public Hearing for the Visitor Center proposed building in the future.

Planning Board:
Road Preservation Law presented by Mark Cornwell for Walter Buist and is subject to modifications. All parts of the rough draft of the Road Preservation Law have been extracted from the current Comprehensive Plan and Wind Law to create a stand alone law entitled Industrial Traffic and Sound Law.
Councilperson Cornwell asked how do we enforce these laws and who will be the permitting authority. Supervisor Garretson stated future entities would need to contact the Highway Superintendent to discuss what roads can handle what equipment, etc.
Proposal inquires requested for Town-wide Assessment Re-eval Project has been sent to the papers by Supervisor Garretson. Motion made by Councilperson Cornwell to have a re-evaluation of the Town seconded by Councilperson Johnson. Motion carried.

Highway Department:
Town Barn dumpster change-Vet’s/Casella to Wheelock Disposal.
County Snow and Ice Contract review and concerns. Need a resolution for 3 years, however Supervisor Garretson spoke with Highway Superintendent VanDerWerker and decided on 1 year renewal term.

Federal/State/County:
Road lines requested on County Route 32
State Route 166 bridge project presentation-update
Supervisor Garretson received notification from FEMA the Town’s Flood Plan has been updated and revised.

Land Use Committee:
Land Use Regulation Document is ready for public viewing. Will need multiple copies placed in various locations and on the website for the public to view.

Alternative/Renewable Energy Committee:
NYS wind law setbacks document to be completed by year end. Councilperson Cornwell will wrap up Excel spread sheet.

Supervisor Garretson presented the 2010 Town of Cherry Valley Preliminary Budget. A Public Hearing for the Preliminary Budget will be held on November 12th, 2009 at the Town Barn Main Street Cherry Valley, NY County of Otsego at 7:00 o’clock PM. The Town Clerk will publish the notice in the 3 Town Newspapers.

Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Cornwell seconded the motion. The invoices and payments have been presented and accepted. All in favor 3 yes 0 no. Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
County sales tax revenue for June was $4,301.
Presentation of Tentative Budget for 2010
October Town Board meeting will be the Preliminary Budget.

Updates
Community Center:
Revenue for August was $1,095 and Expenses were $3,335
Payment received from the WIC program. Invoice sent to Glimmerglass Opera.
September 22 Assemblyman Marc Butler will be holding a Town Hall meeting starting at 7:00pm
September 23 NYSDOT will beholding a public meeting about the upcoming bridge project slated for the bridge entering the village on Route 166.

Miscellaneous Information:

Received a letter from Steve Eisenberg of Reunion Power stating Reunion Power is ceasing their wind energy developments in Cherry Valley
Received a thank you note from the Roseboom Senior Citizens for the Towns donation.

Health Center:
Revenue for August was $29,958 and Expenses were $28,575.

Village:

American Legion 5K Run/Walk is scheduled for Veteran’s Day weekend, November 7, 2009. Applications are available outside the Town Clerks Office and also at Larry’s Barber shop.

Visitor’s Center:
Lease agreement signed by NYSDOT and the Town of Cherry Valley.
Foit-Albert request of information letters sent to various agencies.

Planning Board had no official business. Walter Buist read a statement from the Planning Board to the Town Board making recommendations to add 2 new laws for excessive noise from industrial noise and excessive use of roadways from industrial traffic.

Highway Department:
Rabies clinic scheduled for September 15 from 6-8PM
New truck anticipated delivery date is end of October

Land Use Committee:
Presentation of proposed local law-Public hearing is postponed until November.

Federal/State/ County:
Road lines requested on County Route 32. Stones will be swept and lined.
State Route 166 bridge project presentation by Jillian Drapper from the NYSDOT will be at the Community Center on September 23 @ 5:00PM

Alternative/Renewable Energy Committee:
Update on comparable NYS wind law setbacks-nothing new to report as of this meeting.

Resolution 2009-6: required examination of justice court records.

PROPOSED ACTION: Required annual examination and audit of town justice court records and dockets

WHEREAS: Section 2019-a of the Uniform Justice Court Act requires that town justices annually provide their court records and dockets to their respective town auditing boards, and that such records then be examined or audited and that fact be entered into the minutes of the board’s proceedings: and

WHEREAS: The town justice has presented the court records and dockets to the town board for examination and audit: and

Whereas, the said agreement provides for an annual update of the estimated expenditure to be determined by NYS DOT, and

WHEREAS: Record of this examination, audit and resolution will be forwarded to Dennis W. Donnelly, Director of Internal Audit, NYS Office of Court of Court Administration, 98 Niver Street, Cohoes, NY 12047; and

NOW, THEREFORE, BE IT RESOLVED: The town board conducted the required examination and audit of the court records and dockets of the town justice on January 8th 2009.

Motion made by Councilperson Johnson to accept Resolution 2009-6 required examination of justice court records second by Councilperson Cornwell. Roll Call vote is taken Supervisor Garretson-yes, Councilperson Johnson-yes, and Councilperson Cornwell-yes. Resolution is duly carried.
