Town Facilities: • Frank McGrath sent Supervisor Garretson an email with some suggestions regarding the problem at the recyclable bins. The suggestions were shared with the Board. Community Facilities Corp/Old School • Apartments are progressing slowly Town Planning Board: • Supervisor Garretson handed out contact information for the Town Planning Board Supervisor Garretson reported the Town has to come up with a written plan for future pandemic policy and procedures to submit to the State. Supervisor Garretson will be in touch with the Town Attorney, Will Green regarding this plan. Village: • Town and Village Board Minutes and info- www.cherryvalleyny.us Highway Department: • Town Attorney, Will Green, suggested the Town Board award the annual truck bond bid to NBT Bank. Motion made by Councilperson VanDerwerker to award the annual truck bond bid to NBT Bank, 2nd by Councilperson Cornwell. All in favor 4-yes and 0-no. • Estoppel Notice will be sent to the Town Clerk to place in the paper. • Supervisor Garretson received a letter from the state regarding the shared notice agreement has expired. Resolution 2020-11 Standard Work Day Reporting for Elected and Appointed Officials-NYSLRS Form RS 2417-A This new resolution needs to be drafted to replace the previous Resolution as we did not meet all the requirements as laid out by the State. The new Resolution will be posted for 30 days as well as proof of an ad posted in the paper of the posting outside the Town Clerk’s office of the Standard Work Day Reporting for Elected and Appointed Officials. DRAFT ONLY TB MEETING NOVEMBER 12, 2020 Village: Town and Village Board Minutes and info- www.cherryvalleyny.us Highway Department: • Supervisor Garretson received an email from Nick Pressley regarding the speed limit in front of his house is 55mph and after his house is 45mph. He is asking if this can be reduced to 45mph. The Town will have to send an inquiry to the County and then the County has to submit a request to the State. This has been done in the past and the State denied the change. • Supervisor Garretson received a quote for the standby generator to be installed at the Town Garage so the overhead garage doors can be opened in the event of a power outage. A discussion was held by the Board members present and all are in favor of the quote to install the standby generator. Supervisor Garretson received another letter from the County regarding the recyclable bin problem the Town continues to have with individuals dumping garbage and other non recyclable debris in the bins. Supervisor will be calling the County to pull the recyclable bins as we do not have a way to monitor the abuse of the garbage/debris dumping. He would like a back up plan before he initiates the removal of the recyclable containers. Supervisor Garretson presented the 2021 Town of Cherry Valley Budget to the Board for adoption, motion made to accept the Budget as presented is made by Councilperson Johnson and seconded by Councilperson Cornwell. All in favor 4 yes 0 no. Motion carried. Budget 2021 is adopted. Town Planning Board: • Revised By-Laws are presented to the Town Board. • Councilperson Cornwell questioned how the Planning Board communicates with the public and who is the main contact person on the Planning Board. Also how does the Planning Board communicate with the public during the Pandemic? • Supervisor Garretson stated the Chairperson is the contact person and the Planning Board follows the same Pandemic protocol the Town Board follows during the Pandemic. In the first few months of the Pandemic no in person meetings and currently in person meetings with masks and social distancing. Village: Town and Village Board Minutes and info- www.cherryvalleyny.us • Transfer paperwork for the parking lot is with the Town Attorney Will Green. Highway Department: • Truck should be ready mid October • Fixing plows and getting ready for winter plow season. • Advertisement for the vacancy at highway has been published. Supervisor Garretson distributed information regarding Palmer Road in regards to excessive four wheelers and motor cross bikes using Palmer Road to get to a piece of land off of County Route 50. Supervisor Garretson contacted the Town Attorney, Will Green, and he is going to draft a letter to the Land Owner regarding the issue. Other than that Supervisor Garretson recommended the neighbors contact the Sheriff and or the State Police for further action. Councilperson Waterfield gave an update on the Draft Solar Law. The draft has been cleaned up before it is sent to the County for review. A Public Hearing will be held before the Law is voted on. Federal/State/County • Representative Dave Bliss attends tonight’s meeting. Mr. Bliss presents an overview of County business. Overall the County is down 10% revenue and it is slowly improving. The County is at a $14 million dollar deficit • With colleges being closed or virtual is a big impact as well. • Bed Tax is down 70% DRAFT ONLY TB MEETING SEPTEMBER 10, 2020 Resolution 2020-8 Standard Work Day Reporting-NYSLRS RS-2417-A NYSLR requires this every year for elected and reelected officials. Public Questions, Comments and concerns…………..2 minute limit per request Angelica Palmer and Kat Chiba attended tonight’s meeting to inquire about fiber optics being installed in the Town limits. Angelica, who is part of a group called Rebirth Cherry Valley, also stated Unadilla recently published they received money from the State to help local people with rehabilitation money for their homes. Angelica is wondering if the Town would be eligible for this grant money. Would the Town be willing to participate in this Grant? Kat inquired about the reasoning for having two different governments? Town and Village are separate government agencies. Kat also stated one of the reasons new businesses are not coming into the Village is due to the fact there is not a sewer system. Kat feels the burden should not be put on the Village residents alone that all, Town and Village residents, should share the burden of the cost of installing a sewer system in the future. Highway Department: • Send the old Grade-All to Teitsworth Auction. • Ad to the newspaper for vacant highway position. • Deputy Highway Superintendent gave a report on the current work happening on Town roads. Recyclable bins are being abused at the Town taxpayer’s expense. Supervisor Garretson was hoping Dave Bliss, County Rep would be in attendance at tonight’s meeting. Councilperson Waterfield spoke to Karen Sullivan last year ago and she suggested mounting cameras and or locking up the bins. Cameras would be costly and have to be monitored and once individuals are identified they would have to be addressed. Councilperson Cornwell asked about removing the bins altogether. This may create more of a mess in the long run. This will continue to be a work in progress. Example someone is dumping used cat litter and this should not be happening. Superintendent Tony Miles will be retiring at the end of September. Dorothy Johnson current Tax Collector will be retiring at the end of this year. Highway Department:
• DHS Field gave an update on highway business. Salt Springville road is in need of some serious attention in certain spots.
• Superintendent of Highways Tony Miles is requesting the seasonal road signs go from April 1 to May 1. Councilperson VanDerwerker stated somewhere in the CHIPS law roads cannot be closed for more than 6 months as seasonal roads. If inclement weather is still causing issues after the 6 month deadline a road block could be put up stating road construction until the road is passable.
• New truck is expected mid October.
• Still waiting on the CHIPS money to come in.

• Supervisor Garretson spoke with Mayor Guido about transferring the Town parking lot the village. More info to come.

Councilperson Waterfield gave an overview of a potential Solar Law. Main concern is who and how will the Town enforce the Law. Some of the bullet points are:
• Reporting and tracking large scale systems
• Owner or operator would have the facility inspected annually and file this report with the Town
• Need to know what needs to be included in report and if everything is sufficient
• Keeping track of where the properties are, who the contact is and have a follow up procedure for what happens if the owner/operator doesn’t file with the Town.
• Planning Board wants to put most of the responsibility on the owner and how to deal with an owner who does not comply, etc.
• Would the Town have a code enforcement officer? The County will not participate in this type of enforcement.
• Supervisor Garretson suggested reaching out to the Town Attorney for wording of a Solar Law.

Supervisor Garretson emailed Dave Bliss regarding the recyclable issues at the Town site. Dave forwarded the email to Karen Sullivan and she forwarded the email to Cassella.

Motion for the Superintendent of Highways to purchase a new truck through the Piggyback program through Chenango County made by Councilperson VanDerwerker Councilperson Johnson 2nd the motion. Motion carried.

Town Justice position currently held by Chris Barown will be on the November Ballot.

Kathleen Taylor presents information regarding School Ballot initiative for the 4 county Library systems. The initiative would address increasing school taxes to meet annual Library budgets. A Library line would appear on the school taxes. The School has to put it on the Ballot in May for the public to vote yeah or nah to increase the taxes to support our local libraries in Cherry Valley and Springfield.

The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.

If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.

Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.

96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Town Supervisor will serve as the Town Budget Officer.

The Budget Officer is authorized to pay employees, insurance, utility, communication and any other due invoices prior to the review and approval of the town board.

The Town Supervisor will serve as Chairman of the Cherry Valley Health Center Board.

The Town Supervisor will provide the Cherry Valley Health Center Board with an annual budget and provide monthly updates of revenue and expense.

Town paid medical, dental and vision insurance coverage is available to full time employees – town paid medical, dental and vision insurance is not available to employees that chose the op-out program. (details below)

An op-out insurance program is available to full time employees - proof of other health insurance coverage is required – the annual op-out payment is based on the single package contract rate premium for the year. The op-out payment for 2020 is $17,808

Cintas work clothes provided daily to the highway department employees

Disability payment to full time employees is $510 / wk

Death benefit - payable to the estate of the full time employee is $100,000

Councilperson Waterfield would like to address the current Town/Village Website. It is difficult to find Town documents on the Web Site. It is difficult to find any Town documents on the Web Site. CP Waterfield is looking into the County’s webite’s shared service to put the Town documents on their Web Site.

Scott Moxham from On Time Waste respectfully commented on the County recyclable bins overflowing while he is in attendance for garbage pick up. People are very upset and frustrated and he is taking a lot of heat for this problem that does not belong to On Time Waste. Hoping there is resolution to this issue with the County Recyclable bins in the near future.
