Misc. information to the Town Clerk:
• Sales tax for the month of OCT $6,789.95
• Supervisor Garretson is moving the February meeting from February 13 to February 6. This will be advertised in The Daily Star as well as the Cherry Valley website.

Community Center Alden Field and Park:
• Biddy Basketball season has begun
• Corn Hole League will be starting in January on Tuesday nights starting at 7:00PM

Village:
• Town and Village Board Minutes and info- www.cherryvalleyny.us

Planning Board:
• Planning Board submitted a Solar Regulations packet to the Town Board for their review and comments.
• Supervisor Garretson received a call from Adam Mitchell and is interested in purchasing the CV Hardware store and is looking for extra property via the Town parking lot for miscellaneous use. Supervisor Garretson spoke with the Town Attorney, Will Green, and discussed leasing the parking lot to Adam and to the Village instead of selling the land solely to the Village.

Highway Department:
• Superintendent of Highways Miles met with an underwriter for the insurance companies for an audit and there were two items that needed to be addressed, signs for the building and a container for flammable liquids. Emergency shut off valve for the diesel tank. Also driver assessments for all Town Highway employees.

Motion to accept Resolution 2019-6 as presented made by Councilperson VanDerwerker and 2nd by Councilperson Waterfield. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerwerker-yes and Councilperson Waterfield-yes. 4-yes 0-no.
Resolution 2019-6 is duly carried.

• Discussion held regarding ads run in The Daily Star for vacancies in the Town is expensive as The Daily Star runs these ads on Monster, Twitter etc. Next time a vacancy needs to be advertised the Town Clerk will request publication only in The Daily Star and not on any extra media publication.
• Magna 5 telephone company is now SpectroTel
• Notification from Otsego County with new fees for TV’s that are left a at the dump area.

Community Center Alden Field and Park:
• Biddy Basket ball program has started.
• Friday night soccer and Wednesday night open basketball are currently going on.
• Cub Scouts is trying to recruit and perhaps hold their meetings in the conference room.

Health Center:
• Health Center Budget is distributed to the Board

Village:

• Mayor Guido spoke with Supervisor Garretson and inquired if the Town would be interested in selling the Public Parking Lot to the Village. The Town Board will consider this inquisition and there will be further discussions on the matter.

Planning Board:
• Motion made by Councilperson VanDerWerker to appoint Ellen LaSalle to the vacant seat on the Planning Board seconded by Councilperson Waterfield. All in favor 5-yes 0-no
• Planning Board Chair, Julie Barown communicated to the Town Board that the Town Planning Board would like to be included in the Solar Law when drafted.

Highway Department:
• Highway Superintendent Miles will contact Jerry Burillo regarding snow and ice
• Waiting to hear if the truck has been sold. A gentleman from Maine is interested.
• Motion to accept the bid for the truck made by Councilperson Cornwell seconded by Councilperson Johnson. All in favor 5-yes 0-no Motion carried.
• HS Miles presented the extra warranty for the new truck which includes towing and wiring harness is $5,294. It was not included in the Bid. The warranty is for 12 months or 100,000 miles whichever comes first. Town Board ok to purchase.
• Quote on grates for the shop floor is $1,700 and this is presented to the Town Board by HS Miles. Town Board ok to purchase.

Federal/State/County:
• Dave Bliss is present at tonight’s meeting. He states the Village and Richfield Springs are looking into purchasing a used Sheriff’s vehicle for a possible constable shared service.
• Recycling continues to be an issue.

Tentative Budget for 2020 is distributed to the Town Board.

Motion to adopt Local Law 2019-1 Override Tax Levy Limit made by Councilperson Ed VanDerwerker and seconded by Councilperson Holly Waterfield Roll call vote Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerwerker-yes, Councilperson Cornwell-yes and Councilperson Holly Waterfield-yes. 5-yes 0-no Local Law 2019-1 is adopted.

Motion made by Councilperson Cornwell to approve the Conference Registration expense for Town Justice Fred Herr and seconded by Councilperson Johnson. Town Planning:
• Supervisor Garretson received a call from Cory for the Solar Development project happening at CVSCS. Supervisor Garretson advised them to work with the Town Planning Board for further guidance.

Highway Department:
• Highway Superintendent Miles reported the chassis for the new truck is completed and now it is on it’s way to have the box installed.

Resolution 2019-3 NYS now and Ice Contract Amendment
Proposed Action: Amendment to Contract #D01680 of the Municipal Snow and Ice Contract Agreement

Whereas, due to the severity of the winter and the high cost of fuel during the 2018/2019 season, the municipality request that the Municipal Snow and ice Agreement estimated expenditure be revised to reflect the additional lane miles of state roads that were plowed and or treated during the aforementioned season, and the additional costs associated with the higher fuel prices, and

Whereas, all terms and conditions of the original contract extension remain in effect except the original estimated expenditure of $64,059.12 will have an additional adjustment of $45,481.98 for a revised estimated expenditure of $109,541.10, and

Now, therefore be it resolved, this board authorizes Thomas Garretson-Supervisor to enter into amendment B which will adjust the snow and ice contract for a revised payment factor with the New York State Department of Transportation.

Motion to accept Resolution 2019-3 made by Councilperson Cornwell and 2nd by Councilperson Johnson. Roll call vote is take: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerWerker-yes, Councilperson Cornwell-yes and Councilperson Waterfield-yes 5-yes 0-no Resolution 2019-3 duly carried.

Facility Corp:
• Jim Johnson reported there is a meeting Tuesday night to discuss the Senior Living. Some of the money for this project has been received.

Highway Department:
• Truck chassis should be done around July 1 and then scheduled for August to go in for the body
• Mowers and brushes to sweep the roads will be here soon.

Councilperson Cornwell opened the discussion regarding the problem on County Route 34A/Chestnut Street. Supervisor Garretson spoke with the Town Attorney today and he advised the Town Health Officer do an inspection of the situation and files a report with the Town. Further discussions will be held regarding the next step to solving this issue. Several land laws are being violated and the issue will need to be addressed.

Councilperson Cornwell stated the County Health Department drove to the property but refused to go onto the property.

• Julie Barown, Chairperson, informed the board of 2 candidates interested in being appointed to the Town Planning Board. They are Lisa Hershey and Karen Walker. Motion to appoint Lisa Hershey and Karen Walker to the Town Planning Board is made by Councilperson Cornwell 2nd Councilperson Johnson 4 yes 0 no motion carried.

• Dave Bliss County Rep is present at tonight’s meeting and gave an update on County issues.

Motion to accept Resolution 2019-2 made by Councilperson Johnson and 2nd Councilperson VanDerWerker Roll call Vote: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerWerker-yes and Councilperson Cornwell-yes. 4 yes 0 no.


Public Questions, Comments and Concerns:
Karen Sullivan, Planning and solid waste Director for Otsego County and Karey Foster from Casella’s Waste presented packets of information regarding recycling costs for the County and how this affects each Town in Otsego County. Karen’s goal is decreasing contaminated recyclables and re-educate people to clean all of their recyclables. Also asking the Town to come up with a plan to make certain the recyclable site is monitored during the day and during the open areas. Discussed locking the bins during off hours.

Karen also presented Hazardous Mitigation info.

Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Waterfield seconded the motion. The invoices and payments have been presented and accepted. All in favor 4 yes 0 no. Motion carried.

• Letter received from Lydia Lusk regarding proposed Solar panel installation on the Cherry Valley Springfield Central School property.

Community Center Alden Field and Park:
• Biddy basketball season in full swing
• Open basketball Wednesday nights from 7-9 through April 2019
• Proposed pre-school play group for Tuesdays from 9-10:30 Feb-Apr will fall under the Town Youth program. Jen Bishop has agreed to be the contact person for information regarding the play group.

Miscellaneous:
• Town Clerk checking account statements check book and record books were audited by the Town Board.

Town Planning Board:
• Three individuals have contacted Supervisor Garretson regarding the vacancies on the Planning Board. Lisa, Hershey, Dave Lamouret and Kathy Walker.

Village:
• Councilperson Waterfield inquired about what happened with the Village dumping debris from the burned out house on Lancaster St in the Town dump. The Village was fined and had to remove what was dumped in the dump.

Highway Department:
• New plow truck has been ordered and should be ready for the 2019 snow season.
• Motion made by Councilperson VanDerWerker to allow the Town Highway Superintendent start the process again to replace another plow truck motion 2nd by Councilperson Johnson. All in favor 4-yes and 0-no. Motion carried.
• Supervisor Garretson received notification the Town holds the registration for solid waste facility. This must be referring to the Dump.
• Meeting on Jan 29 5-8PM-Hazard mitigation meeting with the County for discussion for emergency stream and culvert intervention. DEC has targeted the Cherry Valley creek watershed will be part of a study in 2019.

The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.

If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.

Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.

96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Town Supervisor will serve as the Town Budget Officer.

The Budget Officer is authorized to pay employees, insurance, utility, communication and any other due invoices prior to the review and approval of the town board.

The Superintendent of Highways is authorized to purchase equipment and replacement parts prior to the review and approval of the town board, not to exceed $3,500

The Superintendent of Highways will provide the Supervisor with overtime hours per highway employee no later then 4pm on Wednesday of the payroll week.

The Town Supervisor will provide the Community Center Director with an annual budget and provide monthly updates of revenue and expense.

The Cherry Valley Community Center Director will be responsible for organizing and conducting an annual meeting with all parties involved with the use and maintenance of the Community Center and Alden Fields.
The Town Supervisor will serve as Chairman of the Cherry Valley Health Center Board.

The Town Supervisor will provide the Cherry Valley Health Center Board with an annual budget and provide monthly updates of revenue and expense.

5 personal days - can be used as needed - no carry over
10 sick days - can be used for sickness only - maximum carry over of 180 days

Town paid medical, dental and vision insurance coverage is available to full time employees – town paid medical, dental and vision insurance is not available to employees that chose the op-out program. (details below)

An op-out insurance program is available to full time employees - proof of other health insurance coverage is required – the annual op-out payment is based on the single package contract rate premium for the year. The op-out payment for 2019 is $10,320

Cintas work clothes provided daily to the highway department employees

Disability payment to full time employees is $510 / wk

Death benefit - payable to the estate of the full time employee is $100,000
