Councilperson Johnson made a motion to accept the invoices and payments as presented; Councilperson Cornwell seconded the motion. The invoices and payments have been presented and accepted. All in favor-4 ayes 0 nays
Presentation of Invoices and Payments:
· Budget reviewed as well as NBT Account balances
· Otsego County sales tax for the month of OCT $9,403.77
· Otsego County Mortgage Tax Distribution $3,042.94
· Waiting for the .gov domain to be approved to move forward with the new website through CivicPlus. Invoice for CivicPlus received and will be paid soon.
Community Center Alden Field and Park:
· Biddy Basketball practices have begun
· Rentals are coming in as well.
Health Center:
· August Expense $82,426/Revenue $38,604
· Kathleen Taylor gave an update on the last meeting of the old Health Center board and the new Health Center Oversight board. The new meeting time for the Health Center Oversight Board will be the first Tuesday of the month at 3:00. Minutes not yet ready. The Athena billing is on pause but this time it’s the hope a NYS grant will pay for it. Lisa Heinrich is currently working on this moving forward. There is still money coming in. A few Board members are in contact with other rural health centers for ideas to see what is going on at other rural health centers.
· Friends group also met but there was no representative from that group present at tonight’s Town Board meeting
· Supervisor Garretson reported Tammy is not comfortable going live with Athena yet. Another month wait is not unreasonable.
Village:
· Town and Village Board Minutes and info- www.cherryvalleyny.us
Planning:
· Frank McGrath reported two items brought before the Planning Board was for property purchase which the Board has nothing to do with so inquiry deferred back to the property owner and the other property is out the Towns boundaries.
· Still looking for members. Currently there are 4 members and would like to have 5 members. Hoping for a chairperson to come on board.
Highway Department:
· Highway Superintendent is excused and is out taking care of roads.
Councilperson Cornwell made a motion to adopt Resolution 2025-12 of the Cherry Valley Town Board
Petty Cash Fund for the Town Tax Collector 2nd by Councilperson VanDerwerker
Proposed Action: Establish a Petty Cash Fund for the Tax Collector
Whereas, the Town Tax Collector does on occasion receive cash for tax bill payments,
and
Whereas, the cash payment is not always in the exact dollar amount of the tax bill, and
Whereas, the Town Tax Collector will need to make change for some cash payments, and
Now, therefore be it resolved: A petty cash fund in the amount of $500.00 is hereby established for the Tax Collector.
All in favor 4 ayes 0 nays. Resolution 2025-12 is duly carried.
Motion made by Councilperson Johnson to adopt Resolution 2025-13 Adopting Local Law No. 1 of 2025, “A Local Law Establishing a Temporary Moratorium on Certain Applications for the Approval of Solar Energy Systems and Wind Energy Conversion Systems That Are Pending or May Be Subsequently Filed with the Town of Cherry Valley” and 2nd by Councilperson Cornwell
All in favor 4 ayes 0 nays. Resolution 2025-13 is duly carried.
Councilperson Cornwell made a motion to adopt Local Law No. 1 of 2025 Moratorium on Wind and Solar Projects “A Local Law Establishing a Temporary Moratorium on Certain Applications for the Approval of Solar Energy Systems and Wind Energy Conversion Systems That Are Pending or May Be Subsequently Filed with the Town of Cherry Valley” Law is attached to the resolution Appendix A. Seconded by Councilperson Johnson.
Roll call vote: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerwerker-yes, Councilperson Cornwell-yes and Councilperson Waterfield-Absent/Excused
All in favor: 4 Ayes 0 Nays Local Law No. 1 of 2025 is passed.
Question from the public:
Frank McGrath inquired about hiring a code enforcement person? Supervisor Garretson stated this needs to be addressed when revising the Comprehensive in 2027 as Solar and Wind Laws need to be addressed first for 2026. Supervisor Garretson will make some calls to other municipalities who have Code Enforcement officers to see if this individual would take on Cherry Valley.
Phil Durkin gave Highway Superintendent Fields a compliment on how well the roads have been maintained. He was able to make it to tonight’s meeting given the inclement weather we are having tonight.
