The regular meeting of the Town Board of Cherry Valley was held on Thursday, January 12, 2012 with meeting called to order at 7:00PM by Supervisor Garretson. 

The following elected individuals were given the Oath of office by Councilperson James Johnson:

Supervisor Garretson made a motion to appoint Tracy Donovan Laughlin to the Town Board, seconded by Mark Cornwell. This appointment is to fill the current vacancy on the Town Board and will expire on December 31, 2012.  The position will be on the Ballot for the General Election in November 2012.  Councilperson Donovan Laughlin is given the Oath of Office.

Councilperson Cornwell made a motion to accept the invoices and payments as read Councilperson Johnson seconded the motion.  The invoices and payments have been presented and accepted.  All in favor 5 yes 0 no.  Motion carried.

 Mike Sullivan from the State Comptrollers Office asked for a copy of the Local Law for the 2% cap override.  Supervisor Garretson asked how early we can pass the Law since this is something we will be doing every year.  Mr. Sullivan stated this can be done any time after the Organizational meeting.  Attorney Green stated this should be done in early September before you start the budget and its good protection.  Supervisor Garretson agreed even if we don’t go above 2%..  Attorney Green stated the tax cap was designed for down state municipalities and it kills the upstate smaller municipalities because of the smaller budgets. Attorney Green stated for examples if smaller municipalities want to give their Highway Employee’s a dollar an hour raise this will break your budget.  Councilperson Cornwell stated or if gas goes up a dollar the budget goes over the 2% cap.

Community Center/Alden Fields and Park: 
 WIC will be sending their quarterly payment.
 Spaghetti dinner scheduled on Feb. 4 for cancer awareness
 Winter Carnival is the first weekend March

Health Center:
 2011 Expense $404,227 and 2011 Revenue $404,359

Supervisor Garretson talked with Tavis Austin, Principal Planner Austin Consulting Services and he will be helping the Town Board out on an as needed basis and will be a contact for Walter Buist, Planning Board chairman.  Tavis will be the Boards “eyes and ears” in terms of helping out in regards to the Delta Highway Program and anything that comes up concerning planning.

Tavis asked if Supervisor Garretson expects his attendance at all Town Board meetings.  Supervisor Garretson stated Tavis, could present his findings in a summary to the Board and if the Board felt they needed further clarification then Tavis’s presence would be requested. Town Clerk Flint mentioned after attending the School for newly elected officials anytime there is communication between people such as e mail that you want as Town Record this needs to be forwarded to the Town Clerk so the communication can be printed and kept as communication.

Annual Organizational Meeting of the Cherry Valley Town Board

January 2012



The Cherry Valley Town Board Meetings will be held on the 2nd Thursday of the month and will be called to order at 7 pm.

If the Town Board is unable to meet on the 2nd Thursday of the month, they will meet on the 3rd Thursday of the month.

Town Board members will begin review of the invoices and payments no later then 6:30 pm on the night of the town board meeting.

96 hours prior notice will be allowed to the Supervisor for consideration of a topic or presentation to appear on the monthly Town Board meeting agenda.

The Superintendent of Highways is authorized to purchase equipment and replacement parts prior to the review and approval of the town board, not to exceed $3000.

The Superintendent of Highways will provide the Supervisor with overtime hours per highway employee no later then 4pm on Wednesday of the payroll week.

The Town Supervisor will provide the Community Center Director with an annual budget and provide monthly updates of revenue and expense.

The Cherry Valley Community Center Director will be responsible for organizing and conducting an annual spring meeting with all parties involved with the use and maintenance of the Community Center and Alden Fields.
The Town Supervisor will serve as Chairman of the Cherry Valley Health Center Board.

The Town Supervisor will provide the Cherry Valley Health Center with an annual budget and provide monthly updates of revenue and expense.

Op-Out Health Insurance Program is available - proof of other health insurance coverage is required - op-out payment is based on the single package contract rate premium for the year.

-Upon review Councilperson Johnson asked for clarification on the unallocated funds paid. This is for Gates Cole Insurance and First Rehab Life Disability Policy-Supervisor Garretson stated this is the Town’s new carrier for Disability Insurance.

-Councilperson Barown asked if we are done paying Foit-Albertson because there is another $1,800 submitted. Supervisor Garretson stated this was for a subcontractor who submitted their invoice late. Supervisor Garretson will be addressing this later in the meeting.

Councilperson Johnson made a motion to accept the invoices and payments as read Councilperson Barown seconded the motion. The invoices and payments have been presented and accepted. All in favor 5 yes 0 no. Motion carried.

Information presented to the Town Clerk by Supervisor Garretson is as follows:
• Budget reviewed as well as NBT Account balances. Supervisor Garretson stated we are amazingly close to budget. Revenue’s up a little bit and expenses are up a little bit. Once the Town receives the salt and sand revenue the budget will be better off going into 2012. A CHIPS check as well as a snow and ice check from the State is expected in the amount of $56,000, which is a partial payment and then the Town will receive the remaining $40,000 at a later date as well as any other adjusted payments. There are usually 3 different installments from the State.
• Town share of monthly County sales tax collected for the month of Sept 2011 is $5,053.56
• Supervisor Garretson presented the Budget for the Health Center to be on file at the Clerk’s Office.
• Received a duplicate Thank You note from the Fireman’s Auxiliary for the donation.
• Supervisor Garretson received a letter from the State Department of Ag & Markets regarding dog licenses, which basically states The Department for Agriculture and Markets’ enforcement of provisions in Article 7 of the Agriculture and Markets Law (AML) relating to municipal shelters and Dog control officers has been under review in recent months. The Department is reviewing its focus on Article 7 requirements working with municipalities. Violations at municipal shelters or by dog control officers can result in monetary penalties as authorized in AML sections 39-40.
• Fire Department budget is presented. Councilperson Barown asked if we received a dollar amount from them. Supervisor Garretson stated we did and it has gone up a fraction of what it was last year to $88,000 and last year it was at approximately $87,000.
• Supervisor Garretson stated after last months Board meeting he called Councilperson Horvath; he did not wait for Attorney Green’s response, and asked him for his resignation. Councilperson Horvath was more than willing to give Supervisor Garretson the resignation letter considering it was brought up at the last Town Board meeting. Resignation letter is on file at the Town Clerk’s Office.
• A lady from the State Comptroller’s office contacted Supervisor Garretson to set up a time to meet with the following individuals Superintendent of Highway, Justices, Town Clerk and the Town Supervisor. She wants to conduct a risk assessment of the Town in regards to the Town’s buildings and make sure they are safe and that notices are posted where they need to be exit signs are functioning things of this nature.

Community Center/Alden Fields and Park:
• Winter Carnival is planned for the first weekend in March. Biddy Basketball has started.

Town Facilities:
• Supervisor Garretson contacted Jeff Stiles and they are going to do a walk through of the Town Buildings and even if we don’t get the $30,000 grant Supervisor Garretson wants to do something with the Town Court area of the Town Barn to make it more presentable for the Justices. This will occur after the first of the year.

Village:

Highway Department:
• Councilperson Barown asked the FEMA inspection was done yet. Highway Superintendent VanDerwerker stated the FEMA inspection has been completed. The FEMA representatives came around and checked out the sites of the work that has been done and what needs to be done yet. There is no time frame as to when the Town will be receiving FEMA dollars. Highway Superintendent VanDerwerker stated the damage was so wide spread there is only four FEMA inspectors for the whole area thus why the delay. Councilperson Barown asked if the budget for 2012 was under the assumption we are not getting any money? Supervisor Garretson stated no the budget for 2012 is under the assumption we will be getting FEMA money.

Going into next year Supervisor Garretson would like the following:
-Councilperson Cornwell to work close with Tavis Austin, Planner, providing he is still willing to work with us and be our eyes and ears in regards to planning.
-Councilperson Barown to look at the Town’s website and make it more user friendly.
-Councilperson Johnson to sit with Supervisor Garretson and rethink the Visitor Center project going forward.

The annual organizational meeting is scheduled for next month. Councilperson Barown stated he will not be here next month due to personal obligations.

Re-elected positions will be sworn in at the January Town Board meeting.

Attorney Green presented the Draft Road Protection Program-Program Manual by Delta Engineers subject to a couple of changes. Attorney Green was going to ask to schedule a public hearing tonight for the next meeting but since Delta is going to make changes to the draft we can not schedule the Public Hearing yet. Attorney Green presented what has been worked up by Delta and the draft not only has the proposal of the Law it has a stop order language to it. In light of this a Public Hearing can not be scheduled until the Town receives the Technical Manual. Delta is incorporating a reference to the Technical Manual and Attorney Green has been asking for over a month and half to get the Technical Manual from Delta; however Delta is stating there are copyright issues. Attorney Green stated there is also FOIL issues in regards to the copyright issues stated by Delta. Attorney Green stated if anyone wishing to come into the Town to do work and they ask for a copy of the Technical Manual the Town Clerk has to issue it at a cost of $.25 per copy. Councilperson Cornwell asked if Delta was trying to protect some kind of trade secret in the law he doesn’t understand. Attorney Green responded with Delta is worried that if the Town’s changed the manual then they, Delta, would be held liable for the rewording. Attorney Green stated this could be solved with a simple disclaimer from Delta right at the beginning of the Manual. Councilperson Cornwell stated that is why we paid them for their expertise why would we, the Board, change the wording.

Town Clerk Flint asked if Walter, Planning Board Chairman, will be putting the Planning Board application on the website as well for people to download when they need to submit their plans to the Planning Board. Councilperson Barown stated he gave my e mail to Walter and he plans on getting the application on the website. Town Clerk Flint stated the application should be on a Town letter head and should reflect the address where to submit the application as well as Planning Board representatives and fee schedule.

Question and comments from the public present:

Richard Page asked what is going to be done with Councilperson Horvath’s seat. Supervisor Garretson stated he does no know at this point and that the seat will have to be filled eventually. Mr. Page stated the seat should have been filled along time ago and what does eventually mean? Supervisor Garretson stated we are not going to fill the seat tonight. Mr. Page asked why not and is there intent to fill it. Supervisor Garretson stated yes we do intend to fill it.

Matt Utter stated this has gone on along time now for 6,8,9 months now and you have 3 names of people interested in the seat. Councilperson Johnson stated no it has only been a month. Mr. Utter stated the Board has known about this way back in the spring. Attorney Green stated the law says Elector and Councilperson Horvath was still registered to vote in the Town of Cherry Valley. Mr. Utter stated I cannot deny that. Mr. Page stated who cares we got to fill the seat. Attorney Green stated it has to be done on an orderly basis. Mr. Page stated the seat should have been on the Ballot and are we going to wait two more years? Attorney Green stated the seat will be on the Ballot next year for sure. Councilperson Barown stated even if we appointed someone tonight there is an election in November 2012 for sure. The appointment would only be until December of 2012. Mr. Page asked nothing? Supervisor Garretson stated not tonight no. Mr. Page: well when? Supervisor Garretson: when we decide who we want to appoint. We just got a resignation letter. Mr. Page: well you knew this was coming. Mr. Utter stated: otherwise you wouldn’t have advertised for it the advertisement wouldn’t have been on the board this is nothing new and I, you can dance around this all you want, but you guys have had plenty of time. The responsible thing---interrupted by Mr. Page stating “I have seen things happen awful fast when you need them to like heavy industry laws get passed through all of a sudden just like that a lot faster than this. This is a Board seat. Supervisor Garretson: I’m not the only one on the Board if someone wants to make a motion to appoint somebody. Councilperson Barown stated he is not prepared to appoint somebody. Supervisor Garretson stated he doesn’t feel he is either. Mr. Andy Minnig stated he would like to point out for many many decades we had a Town Board consisting of two members often one or both of them being absent and Supervisor sitting alone and the problem with Tim’s resignation was really addressed several years ago when the Board was expanded to four Councilman so that we would always have a sufficient number of Councilmen present regardless of what might happen. Supervisor Garretson stated he agrees with that. Mr. Page: You put the other two on we got by with less for the 40 years that I have been here now all of sudden you need two more. Supervisor Garretson asked do we need to fill that position or don’t we? Mr. Page stated I think we should. Supervisor Garretson: you said that we didn’t need to. Mr. Page: well then you need to fire somebody else.

Supervisor Garretson asked were there any other questions? Mr. Page asked what our tax rate is going to be. Mr. Utter do we know that yet dollar per thousand? Supervisor Garretson will have look into that question because the County sets the rate and those taxes are not in yet.

Public Hearing November 10, 2011


Public Hearing for proposed Local Law 2011-4 Override Tax Levy Law was opened at 6:58PM.

Public comment:
Richard Mark opposes the current proposed Law. He feels the current budget cap is adequate. The economy is not getting better and this is not the time to increase the levy to exceed the 2% cap once this law is passed.

Town Attorney Green stated if the State determines the budget is over 2% then the Board will have a safety net for the Town.

No further comments from the public present.

Public hearing closed at 7:05PM.

Public Hearing for the 2012 Preliminary Budget is opened at 7:05PM.
Richard Mark stated the Community Center is losing money and costing the Town to operate. He does not wish to see the Center Closed, but merely pointing out the money situation.

Matt Utter asked what fund the Re-eval was paid from. Supervisor Garretson answered the General Fund.

Miscellaneous updates:
• County Equalization Rates for 2012 Tax Roll list presented to the Town Clerk. Cherry Valley is at 100%

Health Center:
• 2012 Adopted Budget $425,000 (2011 adopted budget $415,000)

Village:

Town Planning:
• Otsego Soil and Water monitoring water quality is being done at 50 county testing sites

Highway Department:
• FEMA-3341-EM Tropical Storm Irene-Designation and Assistance update. Highway Superintendent Ed VanDewerker stated the Town’s estimated cost for repairs is approximately $60,000.

Proposed Local Law 2011-4 Local Budget Override Law is presented to the Board. Motion to accept the proposed Local Law 2011-4 is made by Councilperson Barown and seconded by Councilperson Cornwell. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes.
5 yes 0 no Local Law 2011-4 is duly enacted.

Preliminary Budget is presented to the Board. Motion to accept the Budget as presented by Councilperson Johnson. Seconded by Councilperson Horvath. 2012 Town of Cherry Valley Budget passed.

Resolution 2011-9 County Snow and Ice Agreement for 2012 is presented to the Board. Motion to accept Resolution 2011-9 is made by Councilperson Barown. Seconded by Councilperson Johnson. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no. Duly carried.

Resolution 2011-10 American Tower Corporation is presented to the Board. A discussion ensued between the Board and the Town Attorney, Lynn Green, regarding the inactive Tower assessment being reduced and what happens if the Tower is sold. Attorney Green spoke with the Assessor about the inactive Tower. The assessment could be reduced. Attorney Green requires an authorization letter from the Board to sign a stipulation for the entry of the court order. American Tower Corporation will continue to pay taxes on the Tower. If the Tower is sold substantially above the assessment there will be a new appraisal.
Motion to accept Resolution 2011-10 made by Councilperson Horvath, seconded by Councilperson Barown. Roll call vote is taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no Duly carried.

The aforementioned Local Law, 2012 Budget and Resolutions are filed in the Town Clerk’s office for public viewing.

Question and comments from the public present:
Matt Utter inquired about Councilperson Horvath’s eligibility to still be active on the Town Board in regards to his current residency? The potential vacancy has been advertised for the Spring of 2011.

Kevin Flint inquired if the Town has any By-Laws to refer to regarding the issue of impending vacancies on the Board?

A discussion ensued among the public present. Attorney Green will have to research the issue.
A motion is made by Councilperson Johnson to go into Executive session. Seconded by Councilperson Cornwell.

Motion to leave Executive session and adjourn the meeting made by Councilperson Barown and seconded by Councilperson Cornwell.

• WIC (Woman Infant and Children) program runs every third Thursday from 9:30-2:30

Town Planning:
• Tentatively budget $3,000 to retain Tavis Austin Consulting Service.

Highway Department:
• Delta Road Use Agreement-Councilperson Cornwell deferred to Lynn Green to discuss SEQR process. Mr. Green stated it is unnecessary to do SEQR process. At this point there is no need to push through a Road Use Law.
• Highway files and equipment will be relocated from the Town Court area.
• FEMA-3341-EM Tropical Storm Irene-Designation and Assistance update. Highway Superintendent Ed VandDewerker stated FEMA will be coming for a site visit in the near future. The time line for receiving funding from FEMA can take weeks.
• A motion was made by Councilperson Barown to give permission to trade the 87 Mac truck to Town of Middlefield for 8 new truck tires. Seconded by Councilperson Horvath. Motion carried.

Town of Cherry Valley 2012 Preliminary Budget presented. There will be two public hearings scheduled before next Town Board meeting in November. Public hearing number one will be for a proposed local law to override 2 % tax levy. Public hearing number two will be for the 2012 Preliminary Budget.

  • NYS Department of Taxation and Finance (Transportation Dept.) check $7,567.64.
  • Supervisor Garretson called the NYSDOT inquiring about the Snow and Ice Adjustment check for $37,000.  The Highway Department is also expecting a check from the CHIPS program in the amount of $60,000.
Community Center/Alden Fields and Park: 
  • Reservations are coming in at a steady pace
  • There will be a work detail on September 17 to fix the riverbank and clean up the debris from the flood.
  • Primary Day is September 13 scheduled in the Conference room.
Village:
  • Town and Village board minutes online @ cherryvalleyny.us
Visitor’s Center: 
  • Waiting for feedback from Foit-Albert regarding the lack of bids on the Visitor Center project.  The project will be opened for re-bid in the spring.
Town Planning:
  • Councilperson Cornwell was unable to attend the Road Use meeting with Delta last month.  Councilperson Cornwell did speak with Bill Isley, Supervisor for Springfield, and found out the State will be the lead agency with this particular Road Use issue.  Most likely each Town will have to go through the SEQR process and use their own attorney.  Money paid to Delta will or should be refunded. Cherry Valley will have to pass our own Local Law in terms of Road Use.
Highway Department: 
  • Delta Road Program-Joint SEQR process with County revised.
  • Highway Files and Equipment will be relocated from Town Court Area.

Resolution 2011-6 Snow and Ice Contract Extension 2011/2012 between NYSDOT and Town of Cherry Valley presented.  Supervisor Garretson made a motion to approve Resolution 2011-6, seconded by Councilperson Barown.  Roll call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no Duly carried. 

Resolution 2011-7 Annual Audit of Town Justice Court Records presented:  Councilperson Barown made a motion to approve Resolution 2011-7, seconded by Councilperson Horvath.  Roll call vote was taken; Supervisor Garretson- yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes.  5 yes 0 no.  Duly carried. 

Resolution 2011-8 Justice Court Assistance Grant application presented.  Councilperson Cornwell made a motion to approve Resolution 2011-8, seconded by Councilperson Johnson.  Roll call vote was taken; Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes and Councilperson Horvath-yes.  5 yes 0 no.  Duly carried. 

The tentative budget for 2012 is reviewed.  A public hearing will be held before the November Town Board meeting at 7:00PM.  The Preliminary Budget will be presented at the October Town Board meeting.

One (1) sealed bid was received for the Visitor Center construction. This bid was from Boland’s Excavating and Topsoil, Inc. 1403 Milburn Drive Conklin, NY 13748.

The Town Board rejected the bid. The project will need to be re-bid at a later date.

A discussion ensued with Ken Baldwin, architect with Foit-Albert Architects. Mr. Baldwin will need to take a look at the project and follow up with the Town Board.

A motion was made by Councilperson Horvath to close the meeting and seconded by Councilperson Cornwell. Meeting closed at 8:35PM.

• Town share of monthly County sales tax collected for the month of May 2011 is $8,088.97.
• Daily Star ad for the Completion of the Final Assessment Roll
• Councilperson Barown met with Tim Powers of Cornerstone Telephone Company to review why our phone bills have increased over the past month and Mr. Powers stated phone usage at the Health Center is up.
• Mr. Powers and Councilperson Barown also discussed companies that do credit card transactions. This would be useful for the Town Court system and the Town Clerk to be able to collect fees via credit card transactions.
• Justice Wickwire is looking into a $30,000 grant for renovations to the Court Room at the Town Barn.

Community Center/Alden Fields and Park:
• The Opera’s rehearsals have ended and a bill will be sent to them soon.
• There are a number of reservations coming up.
• There will be a Community Dinner in the fall to benefit the CV Library.
• Councilperson Barown spoke with Jeff Stiles, buildings supervisor, regarding thermo storm windows to put on the windows in the gym. He will be getting quotes from Bruce Hall.

Village:
• Town and Village board minutes online @ cherryvalleyny.us
• Folk Fest for Food has begun and will be August 11, 18 and 25 in the bank parking lot.

Visitor’s Center:
• John Sagendorf is the contact for NYSOGS (Office of General Services) for the general service signs for the Route 20.
• Building proposal bids will be opened on August 25 at the Community Center at 7:00PM.

Town Planning:
• 2012 Budget Workshop will be August 25th at the Community Center at 7:15PM
• Consider including Tavis Austin in the 2012 budget as a resource for Town Planning.

Highway Department:
• Councilperson Cornwell gave an update on the Delta Road Use program. Delta has been paid for the highway survey and Councilperson Cornwell has contacted Delta via e-mail for updates on where they are in the process. Eleven of fourteen towns have signed on with Delta to use their attorneys for the model Law. A question was raised whether or not the town will have jurisdiction on who can drive on a particular road. Discretionary authority may want to think about SEQRA for every permit issued. Recommend using a Local Law and using the Town Attorney to pursue or hiring Whiteman, Osterhoudt and Hannah the cost to join is $1,300. The Town could come up with a Road Use agreement.
• There will be a meeting on August 16 at The Meadows with Delta and the County Planning Board regarding the draft Road Use Law.
• Rabies Vaccination free clinic will be September 6th from 6-8PM at the Town Barn/Highway.
• Highway Files and Equipment will need to be relocated from the Town Court Area.

Question and comments from the public present:

Beth Rosenthal, Town Clerk for Roseboom, stated the Town Board may want to consider sending a message to the County regarding not using flow back fluid on the roads during the snow and ice removal or using it to control dust on dirt roads.

Andy Minnig stated legislation was recently passed called Empower New York. This will take away the authority from municipalities to place power plants. The Town Board may want to consider sending a resolution to the Governor.

• Construction Management and Contract Document are tentative. Supervisor Garretson reported the State Bids are handled differently and will be going out in approximately 3 weeks.

Town Planning:
• NYS Real Property Tax Service notice of equalization rate = %100
• NYS 2% Property Tax Cap-Town Budget Review will be at the August meeting. If the Town maintains the 100% equalization rate we will get back $5 per parcel.

Highway Department:
• Delta Road Preservation Program. Joint SEQR process with the County. Supervisor Garretson would like Councilperson Cornwell to work on the Road Preservation Program.
• Free Rabies vaccination Clinic is September 6 from 6-8PM at the Town Barn, Main Street.

Federal/State/County
• The Land Use Document was presented to the County Planning Board, which gave their approval to adopt the CV Land Use Law, before they disbanded.

Resolution 2011-5 Amendment to NYSDOT Snow and Ice Contract was read. Motion to adopt Resolution 2011-5 Amendment to NYSDOT Snow and Ice Contract was made by Councilperson Cornwell and seconded by Councilperson Johnson. Roll Call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes, and Councilperson Horvath-yes. 5 yes 0 no. Duly carried. Resolution 2011-5 NYSDOT Snow and Ice Contract will be filed at the Town Clerk’s office.

Local Law 2011-3 Town of Cherry Valley Land Use Law was read. Motion to enact as presented made by Councilperson Barown seconded by Councilperson Horvath. Roll call vote was taken: Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson Barown-yes, Councilperson Cornwell-yes and Councilperson Horvath-yes. 5 yes 0 no. Duly enacted. Local Law 2011-3 Town of Cherry Valley Land Use Law will be filed at the Town Clerk’s office.

Question and comments from the public present:

Dennis Laughlin wanted to thank the Highway Department for blacktopping Nielson Road.

Karina Gable asked how the Board would handle some one with land who wanted to pursue a Business in their home. Walter Buist Planning Board Chairman commented these would have to be looked at individually.

Supervisor Garretson recommends the Comprehensive Plan adopted in 2007 be reviewed every 5 years.

Kathleen Taylor thanked the Board for protecting the Town with this Law.

• Opera is renting the facility sporadically for the months of June and July

Misc. Updates:
• Designation Petitions for upcoming elections in November are due to the Board of Elections the week of July 11

Health Center:
• Continues to do well.

Town Facilities:
• Hole in public parking lot has been fixed.

Village:
• Town and Village board minutes online @ cherryvalleyny.us

Visitor’s Center:
• Right of Way Clearance Certificate to NYSDOT. The project is moving forward

Town Planning:
• George Cade and Kassy Cade-Laymon reported the Board of Review went well. Approximately 17 people appeared before the Board. There is one issue still pressing.
• Springfield will be going forward with their reevaluation process.
• The Draft Local Land Use Law will be presented to the Otsego County Board meeting on June 13, 2011 at 6:00pm

Highway Department:
• Ed sent new maps to Delta Engineers so they can pick new roads to place counters.
• Single Stream Recycling will be in effect. Meaning all recyclables can now be placed in the same container and plastics, glass and cans do not have to be separated starting July 4, 2011

Question and comments from the public present:
Andy Minnig asked what the date of the Public Hearing will be for the Draft Local Land Use Law? The Public Hearing will be June 16 @ 7:00PM.

Richard Page asked if the Board will be voting on the Final Land Use Law. He feels the Board will be making a big mistake if they pass this law. Mr. Page also stated he felt like the token farmer on the Land Use Committee. He felt a lack of respect.

Matt Utter feels the plan is premature. There is no agriculture assessment. The Board will not be doing Justice for the Town. Gas and mineral rights have not been addressed. The Board has not come to the big land owners in Town and spoken to them to get their opinions. There is more wrong with the plan. Where was Nan Stolzenburg approved as the Town Planner?
