The regular meeting of the Town Board of Cherry Valley was held on Thursday March 09. 2023 with meeting called to order at 7:05PM by Supervisor Garretson

Councilperson VanDerwerker made a motion to accept the invoices and payments as presented, Councilperson Waterfield seconded the motion.  The invoices and payments have been presented and accepted.   All in favor 5 yes 0 no

 

Presentation of Invoices and Payments:

  • Budget reviewed as well as NBT Account balances

 

Misc. information to the Town Clerk:

  • Otsego County Sales Tax for the month of JAN $8,074.54
  • BAR will continue with the same three members, Lou Guido, Brian Haig and Ed Harvey.
  • Building Standards and Codes Report

 

Community Center Alden Field and Park:

  • Biddy Basketball Tournament
  • Spaghetti Dinner and Dance

 

Health Center:

  • Has a new practitioner

 

Village:

  Town Planning:

  • Frank McGrath is present at the meeting tonight and gave an overview of his meeting with Nan regarding the Solar Law and revisions that need to be made.  Also discussed the appeals board needing revised as well.

 

Highway Department:

  • County needs a copy of certificate of liability insurance
  • Keller road resident inquiring about speed limit for Keller Road.  There is a process to follow when requiring a speed limit posting.  SVF would like to see the entire road posted.  Process will be started and this can take up to 6 months to a year to complete.
  • Loader on backorder due to parts being on backorder.  Loader price is locked in.
  • Culverts need to be replaced especially on Barringer Road and Campbell Road.

 

Resolution 2023-3 Annual Examination of the Court Records

PROPOSED ACTION:  Required annual examination and audit of town justice court records and dockets

 

WHEREAS:  Section 2019-a of the Uniform Justice Court Act requires that town justices annually provide their court records and dockets to their respective town auditing boards, and that such records then be examined or audited and that fact be entered into the minutes of the board’s proceedings; and

 

WHEREAS:  Th town supervisor on behalf of the town justices has presented the court records and dockets to the town board for examination and audit; and

 

WHEREAS:  Record of this examination, audit and resolution will be forwarded to Joan Casazza, Internal Control Liaison, NYS Office of Court Administration, 2500 Pong View, Suite LL01, Castleton-on-Hudson, NY  12033; and

 

NOW, THEREFORE, BE ITRESOLVED:  The town board has conducted the required examination and audit of the court records and dockets of the Town of Cherry Valley for the fiscal year ending December 31, 2022

 

Motion to approve Resolution 2023-1accept as presented is made by Councilperson Johnson 2nd Councilperson VanDerwerker  5-yes 0-no

Roll Call vote is taken:

Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerwerker-yes, Councilperson Cornwell-yes and Councilperson Waterfield-yes.

5-yes 0-no Resolution 2023-1 duly carried.

 

Local Law No. 2023-1 The intent of this Local Law is to enact a 7.5% property tax exemption for volunteer firefighter’s and ambulance workers in the Town of Cherry Valley.

 

On file for review at the Town Clerk’s office.

 

Motion to accept as presented Local Law 2023-1 is made by Councilperson VanDerwerker 2nd Councilperson Cornwell. 5yes 0-no

Roll Call vote is taken:

Supervisor Garretson-yes, Councilperson Johnson-yes, Councilperson VanDerwerker-yes, Councilperson Cornwell-yes and Councilperson Waterfield-yes.

5-yes 0-no Local Law 2023-1is enacted.

 

Public Questions, Comments and concerns…………..2 minute limit per request

 

Al Konchar stated having the gates closed to the recyclables has been an inconvenience to him and other residents as well.  He is asking the Board to reconsider this situation concerning having the recyclable gates opened more frequently for Town residents.

 

Phil Durkin is inquiring about Spectrum availability for Town residents?  Why some have it and some don’t. TB recommends contacting Dave Bliss County rep for answers on this subject.

 

Andy Minnig brought up the recent huge grants for revitalization that have been received by other Villages and or Townships.  Wondering if it restricted to Villages?  Supervisor Garretson has been in search of a grant writer.

 

Motion made by Councilperson Cornwell to adjourn the meeting 2nd by Councilperson Johnson

 

There being no further business meeting adjourned at 8:09PM.
