Community Facilities Corp/Old School • May is the unofficial date for decision on resident applications. Town Planning Board: • Lorraine Bosma, chairperson is in attendance tonight. She reports on the Public Hearing for the communication tower being extended and small generator on the ground project on Rendering Works Road. There was no public in attendance for the public hearing. The site plan presented was well put together and the Planning Board had 30 days to ask additional question. However, with that said the Company presenting the project does not need the permission of the PB to move forward with the project. Lorraine stated as projects come forward such as Solar projects etc, the Town Board should have some control or Home Rule regulations. These projects can present to the Town Planning Board as a courtesy but they do not need permission from the Town Planning Board. The State can supersede any Home Rule regulations. Lorraine also requested the Town Board hire a person who can take a look at the proposed Solar Law and Town Comprehension plan and update the plan. The Town Planning Board had several sessions with the County Planning Board and they reviewed the site plan law and were very comfortable with how the site plan law is written. • Councilperson Cornwell will make contact with some professional people he knows for guidance in how to move forward with the proposed Solar Law. • Lorraine also would like to talk about the issue of a Town Code Enforcer. The County Code Enforcer will not enforce local Town Code Laws. Lorraine would like the Town Board to take this into consideration for future projects. Village: • Town and Village Board Minutes and info- www.cherryvalleyny.us • Parking lot that was deeded to the Village with the stipulation the Town has first refusal to buy back. The Village is selling .24 acres for $3,000.00. There was a discussion held by the Board regarding this issue. Highway Department: • Superintendent Field reports the new employee started and is doing well. • Doing some cold patching and getting ready for spring. • The tractor broom is in very bad shape. Motion is made by Councilperson Waterfield to allow the Superintendent of Highways Martin Field to research purchasing a new mower with attachments. 2nd by Councilperson Vanderwerker. All in favor 5yes 0No • Superintendent Garretson states we have more trucks than we have drivers. He would like the old international truck and take to the Spring auction. Councilperson Cornwell inquired about eligible expenses to submit for the American Rescue Plan. Councilperson Waterfield stated the funding will come from the County. Public Questions, Comments and concerns…………..2 minute limit per request Phil Durkin gave an update on the Foxes Den motocross situation on East Hill. Lorraine is under the impression the Town Attorney sent a letter to the Foxes Den individuals. Lorraine has not had a response to her 2 emails to the Town Attorney. If such a letter exits the Town Supervisor Garretson would have been CC or a copy of such letter would have been sent to him and he has not received anything from the Town Attorney. Lorraine wants to clarify, even though the Land Use Law addresses noise nuisances this still does not preclude the land owner from proceeding with a motocross track on their land or any additional land purchased. He is asking if this can be reduced to 45mph. The Town will have to send an inquiry to the County and then the County has to submit a request to the State. This has been done in the past and the State denied the change. • Supervisor Garretson received a quote for the standby generator to be installed at the Town Garage so the overhead garage doors can be opened in the event of a power outage. A discussion was held by the Board members present and all are in favor of the quote to install the standby generator. Supervisor Garretson received another letter from the County regarding the recyclable bin problem the Town continues to have with individuals dumping garbage and other non recyclable debris in the bins. Supervisor will be calling the County to pull the recyclable bins as we do not have a way to monitor the abuse of the garbage/debris dumping. He would like a back up plan before he initiates the removal of the recyclable containers. Supervisor Garretson presented the 2021 Town of Cherry Valley Budget to the Board for adoption, motion made to accept the Budget as presented is made by Councilperson Johnson and seconded by Councilperson Cornwell. Supervisor Garretson distributed information regarding Palmer Road in regards to excessive four wheelers and motor cross bikes using Palmer Road to get to a piece of land off of County Route 50. Supervisor Garretson contacted the Town Attorney, Will Green, and he is going to draft a letter to the Land Owner regarding the issue. Other than that Supervisor Garretson recommended the neighbors contact the Sheriff and or the State Police for further action. Councilperson Waterfield gave an update on the Draft Solar Law. The draft has been cleaned up before it is sent to the County for review. A Public Hearing will be held before the Law is voted on. Federal/State/County • Representative Dave Bliss attends tonight’s meeting. Mr. Bliss presents an overview of County business. Overall the County is down 10% revenue and it is slowly improving. Angelica is wondering if the Town would be eligible for this grant money. Would the Town be willing to participate in this Grant? Kat inquired about the reasoning for having two different governments? Town and Village are separate government agencies. Kat also stated one of the reasons new businesses are not coming into the Village is due to the fact there is not a sewer system. Kat feels the burden should not be put on the Village residents alone that all, Town and Village residents, should share the burden of the cost of installing a sewer system in the future. Highway Department: • Send the old Grade-All to Teitsworth Auction. • Ad to the newspaper for vacant highway position. • Deputy Highway Superintendent gave a report on the current work happening on Town roads. Recyclable bins are being abused at the Town taxpayer’s expense. Supervisor Garretson was hoping Dave Bliss, County Rep would be in attendance at tonight’s meeting. Councilperson Waterfield spoke to Karen Sullivan last year ago and she suggested mounting cameras and or locking up the bins. Cameras would be costly and have to be monitored and once individuals are identified they would have to be addressed. Councilperson Cornwell asked about removing the bins altogether. This may create more of a mess in the long run. This will continue to be a work in progress. Example someone is dumping used cat litter and this should not be happening. Superintendent Tony Miles will be retiring at the end of September. Dorothy Johnson current Tax Collector will be retiring at the end of this year. Resolution 2020-6 Establish the office of Deputy Town Tax Collector PROPOSED ACTION: Establish the office of Deputy Town Tax Collector. Supervisor Garretson would like to bring the Tax Collector position back to the Town Clerk as many Towns have their Town Clerk’s as their Tax Collectors. Motion made by Councilperson VanDerwerker to appoint the Town Clerk, Mary Beth Flint as deputy Town Tax Collector seconded by Councilperson Johnson. All in favor 5-yes 0-no. Dorothy Johnson will be training Mary Beth on the new Tax software as soon as the County downloads it onto the Town Clerk’s computer. New hours will be established and published for the public to make in person tax payments in January. Supervisor Garretson has been in touch with Senator Seward’s office regarding this issue. Councilperson Cornwell stated the Mohawk Valley Regional Economic Council may be an option to look into. • The reservoir for the gas tanks is full of water and producing a foul odor that the next door neighbors are exposed to. A roof with a vent will be placed over the reservoir to prevent water collection in the future.
• A demolition saw was requested by the HDS Fields. Councilperson VanDerwerker gave a quote to him for a demolition saw from his place of employment.
• CHIPS money came through.

• Letter received by Phil Durkin regarding issues happening on County Route 50 with a parcel of land being transformed into a motocross track with concerns of noise and the illegal traffic on County Highway 50. He would like to review the Town’s comprehensive plan.

Community Center Alden Field and Park:
• Community Center remains closed due to COVID 19 pandemic.
• Electronic collection day has been postponed indefinitely for now.

Health Center:

Village:

Highway Department:
• DHS Field gave an update on highway business. Salt Springville road is in need of some serious attention in certain spots.
• Superintendent of Highways Tony Miles is requesting the seasonal road signs go from April 1 to May 1. Councilperson VanDerwerker stated somewhere in the CHIPS law roads cannot be closed for more than 6 months as seasonal roads. If inclement weather is still causing issues after the 6 month deadline a road block could be put up stating road construction until the road is passable.
• New truck is expected mid October.
• Still waiting on the CHIPS money to come in.
