TB MEETING August 10, 2006

The regular meeting of the Town Board of Cherry Valley was held on Thursday, August 10, 2006 with the meeting called to order at 7:00PM by Supervisor Garretson.

Minutes of the July 2006 meeting were read and approved. One correction is made to the minutes. Re-wording is noted in the margins of the July 2006 minute book.

Motion made by Johnson second by Bressett to pay the bills as presented. Motion carried.

Town share of monthly sales tax collected for the month of May 2006 is $7,058.19.

Dog Control Officers report for the month June was read. Report for the month of July is unavailable.

Correspondences read by Supervisor Garretson:

Thank you letter received from Diane Graf, Music Teacher at Cherry Valley Springfield Central School. She Thanked the Town for their continued support of the Summer Instrumental Music Program. Ms. Graf will be retiring this year and hopes the Program will continue after her retirement.

The State Emergency Management is offering municipalities and opportunity to purchase land substantially damaged by the recent flooding in the area.

Letter received from the Town of Sharon Springs Town Board asking that the Town Board of Cherry Valley forward information received regarding the wind turbines, as this project could have a major impact on property in the Center Valley area of the Town of Sharon.

Memorandum from Terry Bliss, Planning Director announcing a Public meeting for Wednesday, August 30 from 7-9:30PM in the Assembly Room at The Meadows Office Building, County Route 33W, South of Cooperstown. Title of meeting: MUNICIPAL COMPREHENSIVE PLANS.

Updates:

Mary Beth Flint reported on the Community Center. She stated the Opera would be responsible for refinishing the gym floor due to damage from duct tape used to secure the floor covering.

A representative from the Village Board was unavailable.

Paul Solomon represented the Comprehensive Planning committee and reported the committee meets every first (1st) Thursday of the month at 7:00PM at the Town Barn. The public is welcome to attend. Mr. Solomon reported the Inventory plan and National/Natural (need to verify) Resources Information is complete. The CPC hopes to hold a Public Informational meeting sometime in September.

Liz Plymell represented the Town Planning Board. TPB approved a minor sub-division for Robert Loucks. Copy of TPB minutes are available for review with the Town Clerk.

Supervisor Garretson read a letter of resignation from Linda Franzese. Mrs. Franzese’s resignation is effective July 19, 2006. The Town Planning Board will run an ad advertising the vacancy on the TPB.

Phil Durkin, County Representative reported the county would be taking bids for the sale of the Annex Building a.k.a the old Victory Supermarket. Mr. Durkin also reported on a company called Elexco Oil and Gas has been in the area inquiring about drilling on private property as well as County owned property.

Old Business:

Supervisor Garretson asked for a motion to be made to accept the Bid from Burr Truck for the purchase of a 2007 4x4 single axle cab & chassis with plow and multiuse dump body with option B diamond plated Tool Box, motion made by Councilperson Bressett, second by Councilperson Johnson, motion carried.

Supervisor Garretson is not ready at the present time to introduce the Wind Energy Local Law #1. Supervisor Garretson asks for a motion to be made to have a Special Town Board meeting on Tuesday, August 15, 2006 at 7:00PM to introduce proposed Wind Energy Local Law #1. Councilperson Bressett made a motion to have Special Town Board meeting as stated above, Councilperson Johnson second the motion. Motion carried.

The Clerk will post notice for Special Town Board meeting as well as send an ad to The Daily Star only due to time constraints.

Supervisor Garretson stated a representative from MRT will be present at Town Board meetings as well as Town Planning Board meetings.

Andy Minnig representing Advocates of Cherry Valley read a statement regarding the July 31, 2006 Public Hearing meeting. This statement is on file with the Town Clerk.

Kat Chiba read two (2) petitions. Petition number 1 asks for a new vote for the 18-month moratorium on all major (Type I) development in the Town of Cherry Valley. This petition includes 179 signatures. Petition number 2 calls to enact legislation for the creation of a new Town Board consisting of four (4) Town Council seats. This petition includes 190 signatures. Petitions are on file with the Town Clerk.

Statement received by the Town Clerk by an unknown individual, there is no identifying name on this statement, and however it is on file with the Town Clerk. The Town Clerk will try to verify the author of said statement at the next Town Board meeting.

Minutes of the Special Town Board meeting were read. Minutes were approved as read with an addendum for the Highway Superintendent to read excused instead of absent.

Open discussions were held with the public present.

will not be allowed a second time to address the board, so be prepared to have your statement ready and presentable with the 2 minute timeframe.

The board will not be answering questions or addressing comments at this public hearing: we will only be documenting your position on the proposal.

If you have any questions about the proposed local law, please contact Supervisor Garretson before July 31 and he will answer your questions.
